Bionic goes bad, I get a reconditioned as replacement?!?

Folks,
Something that just happened to me: Fully charged Bionic wouldn't boot up/recharge last Friday. Took very good care of phone, never dropped, never wet, etc. Pulled battery, changed battery, nothing. Called Verizon support people after going to small local Verizon store (they told me I had to call 877 #). Described everything to rep, said they'd send a replacement, that maybe something failed at a critical point during pushed upgrade, thus the permanent "zombie" state phone was in. Rep said 1 year warranty would cover. FedEx delivers replacement phone Tuesday...guess what? RECONDITIONED! Scratches on front of phone where Moto brand is stamped and front facing camera...I paid $299 for a brand new phone that goes defective after a few months and I get a used, scratched, reconditioned phone as a replacement?!?! WTF?!? Come on Verizon, you don't make enough money already? Anyone else have this happen?

ask for another one. i got a refurb on Friday and it's flawless--no marks, and 4G connectivity is stellar, unlike my launch phone.

Your warranty is with motorola not Verizon. Verizon just fulfills the warranty. If you are unhappy with your warranty options contact Motorola since it's their product

Within the return period (14 days now, sadly) Verizon is obligated to give customers a NEW phone as a replacement, right at the stores. I've gotten several new phones from Verizon when I had those POS Storms. After the return period is up, then they use refurbs (or new, if one "hits the lottery").

I ordered the certified pre-owned Bionic yesterday...I'm gonna be very angry if I get a phone thats scratched.
