Root Broken phone replacement through Asurion

Hello, my brother had my old Incredible, and busted the screen to the point where no light comes on, and it's just black. He already called Asurion to get a replacement, so they sent him an Inc2. My question is, when a phone is sent to asurion for replacement, do they advise Verizon that the TOS were violated, or should I be safe sending a DInc with s-off back to Asurion.

Although a little late now, I would have told them the Dinc. was lost to avoid the question...

I "doubt" they would care, but I can't say for sure. is it just the screen? or is the case broke also? if it had enough internal damage that it wouldn't turn on at all they'd probably just trash it.

and you would have committed insurance fraud.

To the op, if the phone turns on there is a guide to going back to s-on. I'd do that just to be in the safe side (you wouldn't want any $500 invoices coming to you). But don't lose any sleep over it. Asurion probably won't care, and I wouldn't be surprised if the policy completely covers rooted phones.

shrug, I'm sure you break the "law" 10 times a day. We are a litigious society. Its impossible not to break it. Personally, if my 4 yr old niece dropped it in the trash and it went to the dump. oh well...

I'm sorry but that is just a crappy rationalization for fraud. That raises the costs for insurance for everyone. Oh, and as far as this being a "litigious" society (note: litigious refers to civil lawsuits and not criminal laws), I'm guessing we've had insurance fraud laws for as long as we've had insurance.

And I'm sure you pay the "use tax" on you internet purchases? drive the speed limit? never run stop signs?

last week you were giving advice about Wireless tether:

you realize that's against the T.O.S. right?

He was actually helping a user to navigate the forums. Yes, it 'helped' the user find the information likely needed to do something Verizon wouldn't like. It is by no means illegal - you just happen to incur a nice fee if they find out.

Insurance fraud has actual penalization. It's up to each person to decide for themselves.

Now to my point - he was never advocating anything illegal.

Oh, and on-topic for the OP. If you download HTC Sync you can flash over the phone with the RUU which will return it to stock and remove root. They'll just assume you managed to wipe the phone to factory.

Second part of the first post. Nothing needs to be done on the phone itself.

What was being suggested was insurance fraud. Period. I could be a career criminal who breaks every law in the books and it would not change the fact that what was being suggested was fraud.

When I give advise on a forum, whether or not I would do it would not.change the fact that I would let.someone know if the suggestion.breaks.the.law.

You have the same problem typing on your phone as I sometimes do. If you flip your phone upside down it puts less space between your right thumb and the space bar. You won't be hitting the period so much lol.

I respectfully disagree since the suggestion made would be a felony. It should be said and discussed here to give the op a complete answer.

my point being, that the debate would be endless and will end up being off topic to the thread title. Every one has made their point and no one's mind is going to change. The OP's question was answered (*whether or not asurion notifies verizon of a breach of the TOS agreement*). Whether or not it's okay to commit fraud in this situation does not answer that question. Imagine if a thread was made called "is this insurance fraud?". It would not belong in this forum and be moved. Just trying to keep the thread on topic, part of my job.

As to the original question, asurion only deals with insurance claims and doesn't care about verizon terms of service, they are a separate entity.

Fair enough.

I was going to let this go but I'll just leave the "righteous folks with this...

You do realize the SECOND you ROOT your phone you not only void your warranty but ALSO void your insurance through Asurion? So EVEN if you "set it back" you've already committed insurance fraud by their definition?

neither the warranty or the insurance have a "its OK as long as you set back" clause...

Have you READ Asurion's policy? Maybe you should before you make comments like this because you're wrong. I just read it. It doesn't cover damage CAUSED by rooting ( bricking your phone while flashing a radio wouldn't be covered, for example), but other than that there is no exclusion for rooted devices. And verizon shouldn't legally be able to exclude rooted phones from warranty coverage, but that is a completely different topic.

So, to the OP, you're good to go. Asurion doesn't care if you're rooted or not.

Read above please. We are politely asked to refrain from.discussing fraud here.
