Considering that simply downloading a DS ROM and using it, without actually having owned the game, is illegal....

Why not try simply downloading and installing it on your own Elite, if possible, giving it a few test runs, and then uninstalling it if you're not happy with it? Android is based on Linux, which is operating on a UNIX structure, meaning it is inherently secure against viruses (not outright malicious code, but Google screens for this in the Play Store), so it's pretty safe to try it out on your own

Yea give it a go and try it and see if you like it. The most legal way to use an emulator is most likely for games you want to play over again but dont want to lose everything you got in it.
