Root Cant find Google Now on play store?

So supposedly the oe on cm9 can get Google Now but i can't find it on the Play Store.
So how or where else can I get it?

Google now comes preloaded on JB, not available in the market as far as I know since it's a system app.

CM9 is ics anyway right?

It comes packaged with the Google Search app in JB, but we don't have JB yet so we can't get it from the play store.

That's half true I think. Google now ultimately is just an updated Google search which is in the play store. Its just that the version that "activates" the google now is blocked from older versions from downloading it and for good reason. So technically yes its in the play store but unless you are runing jb the phone doesn't have the proper files to run it.

Why is it blocked for good reason? There is no good reason why we get half working phones that aren't even more then 2 years outdated.
