Class Action Suit for 2.0

T-mobile just offered to send me a brand new (refurb) since I am having the infamous SD card formatting issue. I placed an ad on c-list for a refurb behold 2 for $250 and a few ppl wanna come get it as soon as I receive it.

$250 toward the $300 of the MT3GS :)
 
good news samsung is getting pissed off and could do us one better.

you do know that @SamsungFirmware is only for international samsung phones, right? they don't host or know anything about american firmware i.e. the behold 2! they are referring european and asian markets, which might include the galaxy, but plans for the galaxy have nothing to do with the plans for the behold 2. the two phones share nothing but similar hardware. there are four samsung twitter pages that service the USA (really only three): @SamsungMobileUS, @SamsungService, @Samsungtweets, and @Samsung (no responses or new posts ever on this page).

I'm seriously looking into a class action suit here. Even though I'm just a law student, there certainly looks to be precedent here.

Samsung specifically stated in advertisements and even the introduction video that we would be getting 2.0. It is the reason a lot of us bought it. There is definite cause here and I'll be investigating the possibility.

Anyone thinking the same thing?

there is a precedent here. US laws protect consumers from false and deliberately misleading advertisement. its a tough case though cause we must prove that samsung and tmobile knowingly deceived people. those promo-videos that ARE REAL go along way to show the promise made and intent to update the software, but doesn't show intent to deceive the public. samsung can simply say they ment it at the time and fully intended to release updates, but "unforeseen limitations" to the hardware prevented the update from being viable.

Possibly but in the case of galaxy it would still be a good thing seeing as we use galaxy roms. in theory if they get 2.1 or 2.2 we could also possibly get said OS through Custom Roms:cool:
 
the other issue here is the fact that sellers may have problems with customer satisfaction, the lawsuit would be much more powerful if there was someone who sold phones to customers because of the 2.0 and now they lost business

Though the seller may not have a claim based on the contract they have with t-mo and samsung.

A side note, tmo is horrible with support for their phones, I used to have blackberry 8320 and os 5 was out for 8310 and 8330, the only difference between the 8310 and 20 is the wifi, however RIM said it was possible. Long story short

alright all we ask for is what we were promised and sold to! check out tmobile forums! alot of peolle are fed up there to! strenghth in numbers and those people fel the same! im with you and keel us informed! ill take this as far as i have to cuz its more than the samsung behold2 its android!!! if samsung gets away with this all manufacturers will end up dropping support for phones that are not #1 sellers!

It seems so. Just ask Behold owners. They got shafted when the Behold II came out. Ditto Galaxy? All the more reason for me not to consider purchasing any of their product again. Could it be that taking a person's money under the pretense of providing updates and high quality and then abandoning customers is a business model?

Verizon has 900 minutes plus text and web for 100 bucks.

I have been eagerly awaiting the new Galaxy S...But I wonder what its future will be like.
Hell 1.6 would be a huge upgrade for us...
I am thinking though that a more 'generic" phone like the Nexus One will be easier to support and upgrade down the line..
Maybe I'll just hang on to the BH2 till a "Nexus Two" come along

we already have a 1.6 rom that works very good.
 
I think if we call and state we will be filing a lawsuit and that we want to talk to someone "IN CHARGE" We will get that person. If we state what our deal is, they will listen. Big companies would much rather pay off 100 people, than have to pay thousands.
 
I know for a fact that sales reps in Washington State were promising that the phone would get upgraded to 2.0. That constitutes a verbal contract, which is legally binding under Washington State business law.
 
Samsung owes us the fully functional top-of-the-line Android phone that they led us to believe the Behold II is. That is not what we have. The key is to stick together and demand that they take back the Behold II for the lemon that it has been to us and that a top of the line replacement other than the Behold II be given to us...Or, full financial restitution. It is time for Samsung to come to the table with our phones. The Behold II has never been the phone that was promised to us. It is a phone whose best native operations live in theory or root only.

that is correct! happened to me.. part of the reason why i bought the freaking phone.. i knew 2.x would be coming out soon.. and they promised that it would be updated!
