Root CWM ebay issue, need advice

Well long story short, I sold my elite on ebay with cwm installed. I made notes of what cwm is, links to info, and a disclaimer not to factory reset. I also included a note in the phone box with this warning. I stated no returns, no liability, and know what you are buying before bidding. So, to the issue, about 5 hours after it was marked delivered, I get an email stating is is boot looping from the android to the LG logo. Then 10 minutes later I get the eBay dispute opened message for not as described.

My questions are can a fully working phone get this boot loop from shipping? Should I just bite the bullet and eat return shipping and issue a return? And hope it can be recovered.

Edit: I kinda figure that I'm sol, and the same thing can happen anytime you sell a phone/device on ebay. Should I offer to fix it and send it back? Should I have him pay shipping?

in your item, did you show the phone, powered on? You said it stated no returns, no liability in your post as well.. That in itself should clear you from ebay doing a chargeback. If the person you sold the phone to, is being easy to deal with, offer them the option to return the phone (at their costs) and you'd be willing to FIX it. You would just have to eat the return shipping back to them.

I would FIX the phone with the factory re-install of the software that came on the phone. (the post on here about how to unbrick a phone). This way, there is no CWM installed, and the phone will boot 100% perfect. You can include a small video you could make on youtube as well, showing you opening the returned phone from the package, fix it, make video showing its been repaired, and then send the phone back.

I think you are covered because of your stated terms. but, I always include a AS-IS, NO RETURNS. Message in my sales.
 
I had a picture of it at the Virgin mobile boot picture, but no full boots. It booted fine probably about 6 times after I reinstalled Leslie stock rom. I have never had any issue with this phone. That will be my next step is to offer to fix it, but I bet it gets declined. It seems like buyers remorse or he cloned the esn. He did have at least 12 negative feedbacks in 600.

Either way if it gets further in the eBay dispute they will most likely favor him. That seems to be the way it goes with this "item not as described" disputes.

I'm wondering if this boot loop can be caused by shipping, or if is pretty much a factory reset attempt issue.

I also find it weird that I received the message from the user, then 10 minutes later a dispute was opened. In the comments the user stated I did not respond to his messages, and he wants a full refund and me to pay shipping back to me.
 
Yeah he tried to factory reset from the settings. There's no way it just stopped working on its own from being shipped.

I would just have him send it back and try to get him to pay one of the shipping charges. Maybe ask him to pay both shipping charges and hope he negotiates down to one. Lesson learned, make sure it's 100% stock next time. Good luck!
 
Yup. He could have done it even if it was stock, if he didn't want it or is doing something else fishy. All he has to say is it won't boot up and file a dispute.
 
Update, I emailed him and said I will graciously fix it for free, but he will have to cover shipping both ways. I'm waiting for the angry response. lol
 
Well I'm an ass... I would just tell him to suck it and next time follow the signs that say "DONT DO THIS OR YOU DIE" But it's obvious some ppl just wanna watch the world burn... technically it's his fault and you should be explaining that to EBay because you included several warning and he did the thing you warned him not too so it isn't your problem technically. Just direct him to the unbrick thread and that would be a lot easier then all of the crap your going through. Maybe ask him to use team viewer and you can work with him.
 
If ppl can't follow the simplest of instructions then they really shouldn't buy things that need instructions.
 
Update 2, got a reply. Just as I suspected, the buyer does not want it fixed, he wants a refund. He does not want the phone, his words.

So the question is, what are the chances he bought the phone just to clone the esn? And what is there to do about it?
 
I'd say in the likely event that you're being screwed around, your best bet is to call Virgin and find out what they do in this kind of situation. That, or get the phone back as quickly as possible, sell it to somebody on craigslist, and let them deal with the potential of having a bad esn.
 
just wondering, did you look at his feedback? and see what he sells/buys? or how many negitive feedbacks he has?

You gave out the warnings, you're liability and return-free. He has to suck it up, and deal with it or act like a little kid - either way, this info was out there before he even bid, so you should be just fine. You were even nice enough to offer to fix it :) But at this point, I would do nothing - there's nothing you have to do, that I can see at the moment.
 
I also hope all the messages that were being sent, back and forth, was in the ebay message center.
The reason you DO want to do this, is because ebay DOES look in there to see what the conversation was. And since you offered a repair, and was trying to be nice, but the other person denied and wants a refund, you're free and clear.

However, if these emails were just between you and him, from your personal Email address, you're gonna have a he said, he said match with ebay.
 
Yes they were in the message center and I copied them to the dispute page log. So of he sends it to the eBay dispute crew they will send them also.

I haven't heard back from the last message I sent him restating I will fix it or help him fix it. Even though I stated I the auction that I won't provide technical support for issues. I also stated my concern of not having security against esn theft.
 
I tried using EBay to sell my iPod Touch 2G a few weeks ago. I had it posted and everything but they decided to cancel my account and pull my item. Why? Because I didn't provide my routing number on checks. I'm 19, and I don't have the need to use checks lol. It was bullshit. xD So just in general EBay is a big pain in the ass.
 
SNAD is a way to return ANYTHING on eBay, no matter what terms you dictate, and those with buyers remorse usually just lie about the reason. The buyer will always win a SNAD case unless they get caught in a lie or state in a message that it is buyers remorse.

This is why you should never sell anything on eBay that you are not willing to lose. This is also the reason you may as well include a generous return policy, because everyone can return any item within 45 days using SNAD anyway (on most items ).

You usually define who pays return shipping when setting up your auction. You should always make the buyer pay return shipping, unless you are at fault, and the consensus here appears to be that the buyer is at fault.

And you don't need checks to obtain a routing number for your bank account. If you don't have a bank account, there are many free online options.
 
Yeah, I'm figuring Ebay will end the dispute in favor of the seller. I'm just hoping that the phone comes back with a good ESN, and I can resell it. If it has been cloned, I will just take the hit (cost of phone and probably shipping /ebay fees) and donate it for CM developement. Pretty sad it was a perfect phone condition wise, and I never had any booting problems with it. All I'm getting from the seller is that he wants a full refund and I pay shipping. I sent paragraphs stating were I'm coming from, giving information, and my concerns. And all I get back is a sentence.


I could use a few statements that this issue can only be caused by doing what I said not to, and factory resetting through the phones settings. PM me your confirmation statement and your experience, if you like.

Dude just tell him to eat it. Really. He's being rude because he screwed up, is obviously only like 15 years old and his Mom probably bought it. That doesn't sound like an adult that bought your phone. I'd just deactivate my EBay account and tell him to screw himself. :3

Fortunately it doesn't work like that. Ebay and Paypal hold the money until the item is delivered and the buyer is satisfied. If he deactivated his account then he would lose the money and the phone.

I sell a lot on ebay and sometime get an irrational person.

You did state it in the auction that the phone had CWM and not to rest the phone which he apparently did.
I have sold old phones before, none on ebay, just Craigslist. (I always try Craiglist first to avoid ebay fees)
I always return the phone to 100% stock before selling. This would have eliminated your dilemma.

Yes. I listed it had cwm, I linked to my auction in one if my early posts. . Even if it was completely stock he could have pulled the same scam. All he has to do is get the phone, do what you want to it, brick it and start a not as described dispute. Anybody can claim any phone is bricked, and get a refund, all you have to do is brick it a say it came that way.
 
Stories like this combined with 20 years in the service industry make me really not like some people. You stated no liability etc. It's not your fault the guy didn't pay attention and went ahead and bricked the phone out of the box.

Reminds me of when I was managing a sandwich shop. This guy orders a sandwich, I let him know it had dijon and not yellow mustard. He said ok. He sits down, takes a bite, spits it out and starts complaining that it had dijon. Wtf

The point is it seems you were in the right, the customer ISN'T always right and he is either stupid, trying to get something for free, or both.
