Sometimes when I press the lock button on my incredible to wake it up it goes straight to home with no lockscreen and the only way to fix it is to turn off the phone.

So I am clear, are you saying that once the lockscreen is not there once, it is not there any more at all till a reboot?
Are you running or have you ran any of the following:
-Task Killer
-Task Manager
-No Lock App
-Lockbot App (or any lock alternative app for that matter)
-Home replacements (Launcherpro, Helix, ADW)
