Help Headphones defective?

I think the headphones are defective that came with the phone.
They kept turning the volume down and up by itself and wouldn't let me turn off the screen until I unplugged them.
When I got a phone call with headphones in their was loud static and the person on the other end could hear it.
When screen was on I could watch the volume going up or down, I got the phone two days ago.

Do you think t-mobile would do anything about that?
Do they sound defective?
 
Well thanks for the advice jk but, I can confirm it was the headphones as I've been using headphones from the s3 and they are working fine no problems. I guess these were stupid questions Oh well I'll just use these from the s3 until they don't work.
 
They are almost certainly broken and yes, T-Mobile will replace them for you as they are required to do by law.
