Help Help please may need return contract phone desire s

innocent

Lurker
I hope someone can help.
I have just got the Desire S from Mobilephonesdirect but I dont think I lik it. The first thing i noticed is it cant find any gps. When i go to nav it says searching for gps and stays like that for ever. I still have my old desire and it works straight away on that. So the problem is definitely with the phone. I have enabled all the gps settings thats not the problem. Another thing im searching for someone who I know is on facebook and its saying there are no users with that name. Yet i tried it on my desire and it found it straight away.
I've never had any problems like this on my desire but the S is nothing but problems. What could be wrong and what should I do.
Thanks.

Call mobilephonesdirect to check your options for returning/replacing it. If you're in the UK, I think you only have 14 days to change your mind regarding any new contract/phone and send it back, otherwise you're obliged to stick with the contract you have and the phone model (although you will be able to get it replaced with the same model if it's faulty). It also depends on whether the contract is an upgrade or not. Upgrades are a continuation of existing contracts, so as as soon as you accept the new SIM or plan via text, then you're locked into your contract and phone. There's no 14 day cool off with an upgrade - it's down to the discretion of your service provider. With Orange, I was advised I had 7 days to change my mind.

The other options you can try are 1) turning the phone on/off, 2) restarting the phone, 3) a factory reset. The first two have worked for me with other issues on the Desire S.

Also, have you tried downloading another app that connects to Facebook and seeing if that works? Or you could try to uninstall the Facebook app, then reinstalling it to see if that shifts any problem.

This is what it says on their website. I have put the sim in the phone.
You can return the phone for refund or exchange within 7 days from date of delivery subject to the goods being returned to us as new, unused and complete with original manufacturer's packaging. If you intend to return the phone, do not insert a SIM card as this creates user's settings that will personalise the phone to you and your network.
Phones that are faulty out-of-box as determined by our warehouse can also be returned for an extended period of up to 7 days from date of delivery. Some minor faults can be rectified by a simple download of the latest release of the manufacturer's operating software and our customer service team can advise on this and the best course of action.

I should have said you only have 7 days to cool off, although some give longer, like O2 who give 14 days; I think Tesco do, too.

If you've put the SIM in the phone and activated it, then you may have a problem if you want to cancel the contract. What you've quoted appears to say by putting a SIM in the phone, you will not be able to return the phone as new. I'd call them up to clarify what it means and whether or not they will still take it back within the 7 days. (If your phone is faulty and you still want to be on the same contract, then it won't matter - you'll get a replacement.)

If the phone's faulty, then they are still obliged to replace or repair it, but you might find taking it to the service provider's high street shop a better option.

Also, people who cannot get a signal with a provider can usually change the contract, too, after the statutory 7 days is up, but I think you only get a few more days to do it in. It will be worth looking into the Terms & Conditions if this is the case.

If the service provider's cooling off period is longer than that offered by mobilephonesdirect, then maybe that might give you some wriggle room - I don't know, though. You'd have to contact the service provider to see what they say about the situation.

If you have time, you might want to raise this on Money Saving Expert: Credit Cards, Shopping, Bank Charges, Cheap Flights and more, where there will more people who know about UK mobile contracts and third party sellers.
