I bought a galaxy note 2 on an att plan and let it lapse is there anyway to still use it

Just go to AT&T and get a plan or go month to month - they have many options. You can always use your own phone, you don't have to buy a new pone. (They may even use the SIM that's in the phone, but it's more likely that they'll give [as in free] you a new one.)
