HTC Desire - Vol. down button stuck, but the button is fine

Hey guys, I've had my HTC Desire for around a year now, and use it as an mp3 player a lot, specifically I use it to play workout tapes while I work out.

Today I was using it, and the volume kept turning itself down. I turned it back up, and a few seconds later, back down to nothing. Repeated that a few times, and it kept happening.

I played with the volume buttons and they don't feel jammed at all, the vol. down button is clicking fine, doesn't feel stuck or anything. And if that wasn't bad enough, I tried turning my phone off and on, but when turning it on, it still thinks it's held down so it will only boot into (i think it's called boot menu?)

Really need help asap, as I'm a mechanic and work for myself, so all my customers call me on my mobile, so as long as it's not working, neither am I :(

Hardware fault - take it back to the shop for repair and see if they'll supply a loan phone, although assuming you're not on a business contract they're not duty-bound to.
 
Nah I'm not on a business contract. Would this definitely be hardware? My phone is rooted so I'm guessing that voids software warranty
