That being said, as much as I want an update as well I have gotten over it. My phone still serves its purpose more than enough to make me happy. It's still a wonderful phone with the minor glitches and I'm still glad I got it. If 2.2 does come out, great, if not whatever I'm still happy with my phone. I know my personal uses aren't enough to make me root it so I stick with what I've got.
If you guys want 2.2 so bad go root and get a rom on your phone. So much complaining and rarely a good word about the product, if it's THAT bad then go sell it on Craigslist/eBay for $300+ while you can still get that much out of it and replace it. You'd still come out on top considering the possible 6 months of use if you got it near launch and getting back that much cash back too.

I agree with this part of your post. The legal part is more complex and my feeling is that Samsung might be liable for damages if it can be shown that they have an implied responsibility to upgrade their product on a timely basis whether or not they have an expressed commitment contractually. But this is a subject for another thread.
I'm running a completely stock Vibrant although it is a recent build. I bought the Vibrant about a week after roll out and it was a little less than perfect. Mainly my GPS worked but was slow locking up. The warranty exchange (for a different problem) phone I received a couple of months ago is much improved.
Now the GPS locks virtually instantly and the phone "feels" more responsive. I think the tone and content of the Vibrant forums would be more positive had the current iteration been released from the beginning. I for one am happy with the Vibrant.
I also agree with you that now is the time for those unhappy with their Vibrants to unload them and get something else. Either that or do a warranty exchange with Tmobile if they have one built before mid October or are still having problems.
I could not conceive of giving up on this device now that I've seen how nice a phone it is in the recent release/build at least until I qualify for a loyalty upgrade to the next "latest and greatest" device that comes along. Tmobile gave me the Vibrant at no charge on a loyalty upgrade with a 2 year contract extension. I won't upgrade until I can get another deal like that.
