So I fixed it, but I'm not totally sure how. I dumped a few apps here and there that were running, but really didn't seem to be it.
It really looked like it was google maps doing it. I uninstalled the updated maps, but it didn't change anything. I then went into my "all apps" and found the original maps and stopped and disabled it. I then rebooted the phone and for the first time the gps stopped turning on. I then started slowly reinstalling everything I took out finishing up with maps and all seems well now, it stops the GPS when I leave the app.
Now that I think about it, I was in a basement showing my phone to someone the other day and I think I went into google navigator and google maps, set directions, and quickly jumped out before it ever had a chance to get started and find my location (which it was having a hard time doing because I was in a basement). I wonder if I screwed up the maps accessing the gps somehow.
