That should certainly be within the return policy for wherever you purchased it. But they should swap it out for you since it is defective.

How do you test for dead pixels?

you would just see them, they would be pixels that do not change color. so in screens of all black or white you can detect them easily.

Back when I got my Galaxy Nexus I took it back to Verizon after a few days because of a dead pixel and they exchanged it no problem.
