The new market wont let you download large apps w/out wifi. Is there an app that lets you fake wifi? Its not like lte isn't fast enough to download 40 MB
 
I doubt it, have you tried having wifi on but not connected I heard that has worked for some people when playing Order and Chaos as well as some people getting around amazon's wifi requirements on large app downloads. I have never been able to get either to work personally. I doubt it is speed they are worried about but instead uncorrupted downloads and carrier traffic or tethered data plans
 
I don't think it is that easy or it would have been done I am sure of it. You may be able to talk a dev into seeing if they can remove the wifi only restriction from the market app then resign it for you to install, which would likely be easier if it is just on the app side of things and not something being done server side
