I would just like to point out that Radio Shack hasn't said word one to me about my pre order. I have half a mind to show up there today and act very upset to see if I can get anything knocked off. "What I take time off of work for this? You couldn't call your customer to keep them informed?? This is an outrage!!!".

That's seems pretty messed up. I got an email and a call from Best Buy yesterday about the delay.
 
Between advertising and app revenue, Google is expecting to make over $875 million (yes, nearly a billion) off of Android alone this year.

If Google had patented the notification bar, what would have changed? Only thing I see would have been all of us not being able to point out how great iOS 5 is, although we call it Android 1.6.

I guess I am saying that maybe not everything needs patent protection.

What prevents Apple from patenting the pull down notification bar and then going after Android for patent infringement? I only use the notification bar because it was brought up, but in general?
I guess what I'm wondering is what has Google done to prevent others from patenting their ideas and attempting to make them their own? :deal:

This will be my final post on the status of my Pre-Ordered HTC EVO LTE phone. As those that are following know, I have spoken with Account Services everyday this week. I have been given as accurate information that was available to the Agent that handled by call. As of yesterday I was told that the shipping address could not be changed since it was already prepared and I would have to wait on the email and then call and hopefully have it redirected. Today I was told that because of the delay due to Customs, there is no given time frame of when these Pre-Orders might be released. The warehouse then conferenced in on the call and I was again told that they had hoped to be able to release later today or tonight but that is no longer the case. They have no given time frame as of 10:00 a.m. this morning. I then asked if I could cancel my order. The Agent said absolutely, no problem. 2 minutes later my order was cancelled and I no longer have to anticipate delivery. If and when they are delivered, I will purchase. In the meantime, I don't have to worry about delivery date or delivery address. Best of Luck to all that continue to hold out for delivery.
 
Same here BB didn't have a clue and kept telling me it was going to be in on Friday and I called two days in a row. Finally I called back and said look I got an email saying the 23rd which now the newest email doesn't list a date but noone knew. We all saw it on the internet. If I didn't come to the forums every day and go to goodandevo site I would of never known.

Same here... everyone thinks im nuts. lol.. its bad when your debating with the people in radioshack how " no im serious its not coming out on the 18th" they didnt even know when i first caught wind of it...

Her VM stated that as soon as I left the line, her screen changed and it would not accept the cancellation due to already picked and prepped for delivery. I am not sure what that means in a time manner nor do I speak SPRINT-ESE. So, like they said in the movie, III'mmmm BAAACCCKKK.:call:

Dont feel bad.. i preordered from radioshack also and i havent heard a single thing from them... i just call them everyday ;)... i also pre-ordered a blue otterbox defender.. i was wondering if the acc will be in today?? If i cant have the phone atleast i could play pretend with the case! or shove my 3vo in it lol

if i were contemplating cancelling my order i would atleast wait until the end of today.. follow the inside sprint now blog... seems like things are changing.. everyone got the 5/23 date from BB and then they retracted it.. but according to inside sprint that date was mentioned by sprint.. so there is a chance that sprint had BB retract bc they hadnt officially anounced it yet
 
The Inside Sprint Now guy did say that all of the phones outside of the bonded customs area and inside it are already packaged and ready to release for delivery.

There are daily meetings at Sprint on this, so no telling what today's meeting will bring - more of the same or some exciting breakthrough.

Also, thanks to everyone that’s been reading the blog over the past couple of days, I’ve been able to get in touch with someone who actually works for the warehouse in Louisville yesterday! It took me a while to figure out how to verify who they were, but finally I was able to do so. According to them, we have some stock there that is in the foreign trade zone (aka customs) and some that is not. Apparently some of the earlier shipments have been in the racks for a while(some are always held back for replacements, demos, store models, training phones,etc…). They have indeed picked and packed both sections for the ones that are being shipped out, and last night they were prepping for ‘rollout’. I don’t have any more information than that… but I’m determined to find some out today :)

It would be pretty easy to prove prior use.
 
Have had the Evo's back since OG release, but in all reality, the GS3 is creeping its way back into my thoughts...removable battery too. Just sucks that the word on the street is that Samsung sucks with their updates. HTC is Johnny on the spot with them. Bum deal all the way around.

I'm with you on this. Especially since the stateside GSIII is rumored to have 2G ram. I've got a preorder in with BB but I'm not as worried about getting it late or not getting it at all.

That was the old standard and common sense says that's all it should take, but since the dot com mods to the law, it's much more relaxed now.

Case in point, the patent in question here - filed in 1996, and under review for 3 years, and then passed in 1999 after the law change because the paperwork was in order.

I still can't believe that no one's challenged it - other than the fact that if you want to square off with courts and Apple legal, you better have good cause and more money than anyone.

I thought yesterday sprint deciced to allow full refunds? did they retract that also?

Retracted late yesterday. InsideSprint is quoted as saying if you go thru Escalations you might be successful. That is who told me 30 minutes ago that my order is now cancelled and reconfirmed it. As soon as I was off the phone, I was called back and told the system would not fully accept it and I am no longer cancelled. Refusing shipment is the only way to cancel I was told in the voicemail. I am again on the phone with Account Services, on hold, as I type this.
 
They were no attempts to legally protect that feature.

Apple has been free to copy it.

How about Twitter integration?

Yes apple copied this feature. Unfortunately android is open source which means all the lines of coding can be copied. It's good for developers and oems because they can freely change the lines to customize what they want. Not so good because other companies can do the same aka apple can take the notification bar and put some tweaks into it and call it their own.
 
OK yeah just read that part on inside sprint now.. guess i didnt care to look bc i have no desire to cancel.... but for the people that do thats pretty frustrating.. whos really going to send this thing back when they finally get it.. by then their anger will have sizzled out..

The good news is that the free in Free and Open Software Source (FOSS) means free as in speech, not free as in beer (Richard Stallman, GNU founder).

If any of the Android code is used, then either the GNU or Apache open source licenses (or both) must be credited, and all source distribution requirements met.

Android is protected by the Apache license, the underlying Linux components are protected by the GPL or LGPL. All have been successfully defended with zero losses to date.

And the real protection afforded here is the market itself. Imagine Apple wanting to be anywhere near this Google advertisement - Android - so good, it's the basis for the new iOS!

I'd love to see Apple adopt some of the Android code, have that sort of ad go viral and to hear an Android-related lawyer be able to stand up in the next Apple suit and say, "Your honor, we request time to see if this involves some of the Android code used by Apple, an advertised fact." Trying to imagine a judge not giving dirty looks to the bad guys and swinging the hammer the day that happens. :D
