There's a thread over at Sprint Community: 10/12 - Motorola Photon Software Update... with some more info. An employee from Sprint and one from Moto confirm that: "As reported, some devices have been unable to install this update. Sprint and Motorola are diligently working to resolve the issue soon. Additional information will be posted here when it becomes available."
On another note...with or without this update I'm loving the Photon so far. It's a HUGE improvement from my beloved Hero.
