It was leaked because it will never be officially released until the lawsuit is resolved. It is APPLES intellectual property until the courts says otherwise.

And of course they won't knowingly pass along suspect intellectual property unless a court of law says it's okay.

Apple has made an accusation, but HTC's products haven't been judged infringing, nor has Apple been granted a preliminary injunction for showing it has a good chance of winning its case. Both of those mean HTC has no legal obligation to stop shipping its products. Google and Verizon, as others pointed out, aren't named in the suit and have no obligations, either. Worst case for Verizon is that they have to stop selling HTC's products because HTC can no longer legally supply them, and that won't happen until after there's some action in the courtroom.

If HTC were to stop shipping its products over a pending lawsuit, it would give the plaintiff leverage to say, "we filed suit and they stopped shipping, maybe because they believe they're going to lose and wanted to stem the damages."

LOL!!! Are you guys telling me Verizon has no idea that a lawsuit is pending against HTC for stealing intellectual property? That makes no sense! Of course they know.

Of course Verizon knows. We all know. It's been in the news. Corporate legal departments play their cards too close to their chests for that sort of thing to get around prior to filing. But as I said, Verizon isn't party to this suit and is bound only by whatever agreements it has with HTC.

I know this thread is pretty much closed, but I have a few thoughts to add.

1) How does most news of new devices as well as upgrades software changes etc. get around in the tech industry. Answer, its leaked it happens all the time. Do you think we are really supposed to have seen the HTC Incredible? Were we supposed to know that mac was working on the iPad before they announced it? Also, as it has been stated OSs are leaked all the time. Just look at a blackberry forum for the answer to that. This should be enough to explain why its clear that its a leak like happens in the tech industry all the time, and not some huge conspiracy.

2) The courts take time, and trust me. If this case sees a single courtroom before the end of the year I'll be impressed. There is no way anything will be done about this by the courts by the end of the first quarter. Also, much of the public has little to no knowledge about this case. Verizon will want to keep their customers happy, and they will do it however they can. They will release the promised updates to the unknowing public before they are banned from doing so by the courts.

I for one believe that we will see the update within the next two weeks. Thanks for reading my rather large 2 cents.

Oh my goodness, I have been reading these posts and I think I'm going blind. The whole legal system dealing with patents is already broken. This recent news, and law suit by Apple is simple competitive posturing in an effort to slow Android's advance to give Apple time to throw something out there to wow folks. In the end it will mean nothing but re-arranged agreements with companies and satisfying, "I told you so's" in the board room. The competition, however is a good thing for us because that is what spurs ideas on to some really cool features that we all will benefit from. Android will be fine, and we all will eventually cheer an ota of 2.1.

Where HTC erred is thinking touch screen technology is common knowledge. Steve simply got tired of people ripping him off. The facts are pretty clear. IPhone owns the pattent and technology of touch screen phones.

Think about it like this. I can't make a movie called Gravatar using the same characters and premise as Avatar. I am stealing that idea and calling it my own.

Simply put, you can't just jump on the coat tales of someone else without paying the piper.

I feel like we're being trolled. Complete with homophones.

Anyways, touch screen phones were out for less than a year when Apple applied for some of these patents. The technology is obvious. It's like patenting the wheel after it's invented, cause hey, you can't jump on the coat tails!

Also, you chose a horrible analogy. It's called a remake and there are hundreds of them. It's also well known in Hollywood that non-series movies have no trademark protection, so go ahead and drop the 'G'.

That only makes sense if Apple wins an injunction which orders HTC to stop shipping and/or developing their Android products.

It is not a forgone conclusion that will happen.

It seems obvious that HTC and Verizon continue to test the 2.1 update. I think it's possible that the update will not come in March, if the testing does not get approved in time. It will have nothing to do, however, with the Apple lawsuit.

I would rather have the update be as solid as possible and come later on than have it rushed to meet an artificial deadline. 1.5 is working just fine for me right now, though I do look forward to the 2.1 improvements, when it is ready.
