It was leaked because it will never be officially released until the lawsuit is resolved. It is APPLES intellectual property until the courts says otherwise.
And of course they won't knowingly pass along suspect intellectual property unless a court of law says it's okay.
That's not how it works. Apple has made an accusation, but HTC's products haven't been judged infringing, nor has Apple been granted a preliminary injunction for showing it has a good chance of winning its case. Both of those mean HTC has no legal obligation to stop shipping its products. Google and Verizon, as others pointed out, aren't named in the suit and have no obligations, either. Worst case for Verizon is that they have to stop selling HTC's products because HTC can no longer legally supply them, and that won't happen until after there's some action in the courtroom.
If HTC were to stop shipping its products over a pending lawsuit, it would give the plaintiff leverage to say, "we filed suit and they stopped shipping, maybe because they believe they're going to lose and wanted to stem the damages."
LOL!!! Are you guys telling me Verizon has no idea that a lawsuit is pending against HTC for stealing intellectual property? That makes no sense! Of course they know.
Of course Verizon knows. We all know. It's been in the news. Corporate legal departments play their cards too close to their chests for that sort of thing to get around prior to filing. But as I said, Verizon isn't party to this suit and is bound only by whatever agreements it has with HTC.
