Petition against AT&T/Motorola anyone?

Even the Better Business Bureau didn't do anything for you so nothing will happen, sorry.

The BBB is hardly an impartial body. They are appointed by the participating companies (including AT&T), and continuously gives AT&T top marks on its reviews... we found out during the Captivate debacle that the BBB is worthless...

How about the FTC?

How about the FTC?

Go for it. I don't think anyone ever got an answer back from the FTC, but you are getting WAY more press than we ever did. The FTC might have more power in this situation though, as this is an AT&T issue and AT&T is an American company. Maybe not, but it seems like they should have more jurisdiction than they would have over Samsung... or at least more options to pursue...

Here is the FCC letter..

Standard form letter response. You get the same thing if you write in complaining that the cell phone tower down the street is interfering with your TV reception.
You can expect one of 2 things to happen...
-They actually look into the matter and do something (Least likely... possible, but not probable)
-They respond with another form letter stating that AT&T service contract is a "Best effort" contract and that they have found no foul play.

Again, go back to your contract and tell me what it says about your promised speeds. That's what this all boils down to.

Remember, Caveat emptor (Buyer beware). You agreed to the terms of the contract. Show me where AT&T is violating them.

This is what it says (I just copied and pasted from the PDF file you get when you go to your account on their website and click the link to view your contract.) Not the parts I put in RED...

AT&T Contract said:
Service Availability and Access/Coverage: AT&T does not guarantee availability of wireless network. Services may be subject to certain equipment and compatibility/limitations including memory, storage, network availability, coverage, accessibility and data conversion limitations. Services (including without limitation, eligibility requirements, plans, pricing, features and/or service areas) are subject to change without notice. When outside coverage area, access will be limited to information and applications previously downloaded to or resident on your device. Coverage areas vary between AT&T BroadbandConnect, EDGE and GRPS. AT&T BroadbandConnect only available in select markets. See coverage map(s), available at store or from your sales representative, for details. AT&T BroadbandConnect download speeds only available on the AT&T BroadbandConnect network. Actual download speeds depend upon device characteristics, network, network availability and coverage levels, tasks, file characteristics, applications and other factors. Performance may be impacted by transmission limitations, terrain, in-building/in-vehicle use and capacity
constraints.

As you see, they put in there a nice little disclaimer that your speeds my vary based on your device, limitations placed on your device (As in the cap on the Atrix) and network availability.

HSUPA update to be rolled out in April for the Atrix !!

Nice to see an official posting of this, but I've known this for a couple of months. It's not really waiting on anything but the network to come up in the markets they are selling the Atrix.

I not only new this in February, I also knew that the two towers closest to my home and work locations are both getting HSUPA turned up on them.... when? In April.

They did this with a lot of the first 3G phones. Left it crippled in the firmware until the network was ready for it, then rolled out an update.

Sad thing is, there are towers in my area that still have not gotten 3G turned up on them! People in this area have filed complaints with the FCC, filed petitions against AT&T, called their offices... a lot more than your petition, and gotten no results. The same with AT&T's U-verse TV and Fiber. It's on the streets either side of my manager, but they can't say when, or if, it will ever be available to his house.
