Question....Actually, Questions

Though I don't condone the behavior of falsely reporting a phone lost or stolen, I also don't condone the behavior of bashing people. I'm pretty new to this forum, is that how people treat each other here?

well, you gotta say how you feel....

1. yes, reporting your phone lost or stolen to get a new one is weaksauce and it is a reason we pay so much for them and insurance.

2. yes, you will probably get a refurb, it will be pretty much new though, shouldn't have moarks or dings on it.

3. common misconception about returning a unit 3 times in 60 days, that is not the rule, seriously, my wife took her storm back 4 times in 60 days with legitamate issues and she brought it up and they shot her down each time.

Wow ... grow up people. It is insurance fraud - no doubt about that one. But more importantly - IT'S JUST WRONG. Remember how your parents used to teach you about the difference between RIGHT AND WRONG?

Let's split hairs a little, ok? Just for yucks. Let's say Verizon bricks your phone, aka Apple. Did you not, in fact, lose your phone? Let's say you brick your phone or can't upgrade. Isn't it lost? If you got mad at it because it didn't work and threw it on the ground, isn't it damaged? How is this wrong morally? And even if you wanted to be calm and collected, walked into a Verizon store and said your phone doesn't work. Wouldn't you just pay the insurance fees and get a new one? Point being, I don't think they care. I remember I dropped my phone into a toilet, (don't ask) and called the insurance. I told them I dropped it into a bucket of water. (yes, morally wrong because it was a toilet.. sorry mom and dad) But the best part was when the gal on the other end said to me, " Wow, I dropped 2 of my phones into a toilet." I cracked up and admitted to her that's what I had done. Had a new Pearl in 2 days.

Fraud penalties and severity are normally state related. Carmen...stop screwing over the rest of phone consumers by even entertaining this ridiculous idea.

Definition:When someone provides false information to an insurance company in order to gain something of value that he or she would not have received if the truth had been told‚ they’ve committed insurance fraud.

In Pennsylvania‚ this type of dishonest act is classified among the most serious of crimes – it’s considered a felony. Those convicted of the crime face prison time‚ fines‚ legal fees and more – not to mention a wide range of personal and professional consequences.

Question 1:
Let's say Verizon bricks your phone, aka Apple. Did you not, in fact, lose your phone?
IF Verizon were the party responsible for the bricking of your phone then it would fall to their insurance policies they have over their property. Chances are A customer Service role would step in to remove this from your concern while they handle it internally. Ultiamtely Your insurance policy woudl be uninvolved.

Question 2:
Let's say you brick your phone or can't upgrade. Isn't it lost?
IF you brick your phone by performing any type of activity not condoned in your insurance policy they will not be held liable. Therefor to lie about such would be misrepresenting what actually happened, ergo, committing fraud.

The following is an example of what will not be covered:
Code:
i. Programming, Repair Work
Programming, cleaning, adjusting, repairing,
modifying, or performing any other work
upon Covered Property.

Question 3:
If you got mad at it because it didn't work and threw it on the ground, isn't it damaged?
No this is considered intentional damage and will not be covered as described below.

Code:
l. Intentional Loss or Damage
Damage to Covered Property which is the result of it
having been used in a manner inconsistent for which
it was designed or intended by the manufacturer. We
also do not cover damage that is intentional or the
result of abuse.

Question 4:
How is this wrong morally?
Morally? Who cares. Legally, it is wrong because it violates the contract agreement you entered into when signing up for the Equipment coverage.

Morally? Who cares.

"Remember how your parents used to teach you about the difference between RIGHT AND WRONG?"

I thought you might have been talking morals, sorry.

Cleaning is prohibited? Wow. Gotta love those lawyers earning their pay. "Having been used in a manner inconsistent for which it was designed" would include dropping it even accidentally. All legalese, they'll replace your phone if you drop it or get frustrated with it. When I signed up it was to replace the phone for any damage. When I dropped it in the toilet that was quite inconsistent with proper use. But also know you can't get more than a couple or replacements. So don't flush.

Carmen, didnt know you can use Pinch and Zoom on the homescreen, how is that feature enabled

Squeeze the home screen together. All your home screens show up. Select the one you want rather than swiping through them.

you guys are talking about "leap"

if you are running the 2.1 leak it should work

on the homescreen, your main (middle) home screen. if you touch the home button is should zoom out and show all 7 screen.

alternatively, from your any homescreen if you grab the top right and lower left with each finger and pinch them together you should get the same effect.

it definitely works on 2.1...

Good Lord people! Is it fraud in the legal definition? Yes. Is it wrong and does it increase the prices for the rest of us? Yes. Should anyone be shot, maimed, tared & feathered, staked or otherwise grievously harmed for mentioning the idea on an internet forum? No.

I haven't seen this much hostility and righteous indignation since I was chased out of Europe in the late 1700s.

Haha. But does it really increase the prices? How many people actually brick a phone and then "lose" it? The reason our insurance costs went up is because there is no regulation in the industry and they can do whatever the heck they please. They're a corporation, just ask the SCOTUS.

One big factor for cost increases in most industries is loss. If people are losing products, customers, revenue, time etc. The cost of their product or service will increase to counteract that loss. Verizon put an outrageous ETF on their smartphones because of what happened with the Storm and that is just one quick example of cost increasing due to loss.

All I can say is if I were Verizon, saw this thread then saw your posh pompous little self waltz through the front door and try to claim a lost or stolen phone, there would be no length I would not go to to watch them cart her majesty's person to the roughest penal colony this side of Siberia. The fact you think you are owed or assume the right to act like you do is very telling about where this countrys' future lies, with bubble gum smacking knee jerk nitwits such as yourself running around, I have great pause and now worry even more about whether or not my two teenage daughters would lower themselves to entertain the idea of knowing a gem, such as yourself. You are a brat, and a skunk of the first order. Pathetic

Yes. You are sooo right! What we need is cranky old geezers such as yourself clogging up the nursing homes complaining so much about the generation that is paying for your monthly social security checks. BTW YOUR WELCOME!! :D

on a more serious note What the H-E-Double hockey sticks is your problem?????

The loss of what? Multi million dollar bonuses or loss due to the CEO's declining 401K value? That's the reason they increased the costs, they can. I'd love to look at Asurion's bottom line. But fraud... oops.. better not go there again.

Trust me even if a lot of people don't turn anything in, they will not lower the price of insurance. They are going to make as much money as possible. If I were you and you don't want to feel guilty throw your phone in a dumpster then walk away. That way your phone is actually gone.

Also what is the point in paying in insurance if you are never going to use it? I don't get insurance on my phone because "knock on wood" I have never had an incident with my phone and don't want to fork out the money each month. I feel like if you are paying a couple hundred dollars every two years or so then you might as well use it.

Bad logic. I've been paying insurance on my car for years, what if after a few years my paint starts fading? I can key the crap out of it to get a new paint job? I mean I paid for the paintjob through insurance premiums over the years right?

I doesn't matter the size, fraud is fraud. Would you mind if I came to your house and stole something? Even if it was something small?

I didn't say it was perfect logic, but if you do that with your car they raise your own insurance, you have to pay insurance on your car as well. It might not be right but why pay insurance on a phone and lets say mine looks like crap after dropping it several times, would I get a new one? I would say yes.

If the phone is gone then it is gone, simple as that. That is what she is paying insurance for, get it replaced. No one can get into trouble for that, she technically she doesn't have the phone anymore. If she said it was lost and then kept the phone, that would be different. It isn't fraud when they cant prove it.

After all that I would never do this, was just giving an example. I don't personally care what other people do, that is up to them. But I like to be the devil's advocate.

OTD, you are right on the fraud issue.

As far as being chased out from Europe: let's be realistic.
Remember Salem? Today there are more self-righteous narrowminded,
rednecks here than overseas.

I didn't say it was perfect logic, but if you do that with your car they raise your own insurance...

I assume that everybody is talking about the insurance plan from Assurion. In a way, they do provide restrictions if you file a claim; namely, you are only allowed two claims in any 12 month period. After that, they will not provide you insurance, so a third time when you actually need a replacement, you'll be on your own.

lol nobody said that i was actually going to do it. I even said last night that was i was going to deal with it. I made the decision to go to 2.1 so i shouldn't do it. I realize it would be wrong.

these forums crack me up

I really don't get it. I was entertaining the thought of getting the phone but it's ashame that i asked a question about it and i get bashed for it.

it's cool...it makes me laugh.

At some point another our parents did teach us right from wrong as children...

My mom and dad also taught me if i don't have anything kind to say about anybody at all then I should just keep my mouth closed...

LOL it's another double standard

but like it was said before in the last forum...

I asked the question...So I expect some of the responses I get.

I feel sorry for you're daughters knowing me to. I'm an actual pretty decent person compared to what the forums and ppl in it think ;)

1 love
