No, it doesn't come with 5.9.901
I cannot remember, but I think it was on 893 when received it. I manually updated it to 901.
Here is the guide that I followed to root & update to 901 (all the necessary download links are in that guide).
I stopped at step 15 since I don't have time to mess with custom roms (I might do it in the future).

I also have wifi tether apps. It works just fine, however, I DON'T know yet if it is going to show up on my bill for hotspot charges from verizon. Here is the link to wifi tether, it requires to be rooted.

Two things ...

First ... thank you for the information on 5.9.901. On reading your initial message I thought you received the device with it already installed. If you had you would have been the first person to ever report it and that was IMNHO significant. As it turns out you weren't.

Second ... I pay for Mobile Hotspot each month and think it is a great deal. Prior to getting it with my Droid X I needed to pay an extra $60+ each month for a separate number for access from my laptop. In my opinion the use of third-party wireless tethering is wrong, is an example to a lot of companies as to how unprotected the Android system is, and has resulted in numerous shutdowns of capabilities that would have been nice to have.

Well this is for regarding mobile hotspot/tethering; I don't intend on using mobile hotspot/tethering, I installed just to test the feature.
I have the unlimited data plan, and I use less than 1GB of data each month, just to say that I am not abusing nor need to have mobile hotspot feature.

However, I would like to make a point about being right or wrong on using third-party wifi tethering. I believe we should pay for using mobile hotspot/tethering feature for a flat fee, BUT NOT THE WAY VERIZON OR ANY OTHER WIRELESS COMPANIES ARE CHARGING IT.

Let me get it straight; I (or anyone for that matter) would be happy to pay a flat fee to use mobile hotspot/tethering feature on top of the data plan because we are essentially sharing the data plan with more than one devices.
Tethering is just simply networking (your device functioning as a wireless router) among 2 or more connected devices; it requires NO services from wireless companies. Yet Verizon and other wireless companies are charging their customers for something they provide NO services.

Let me give you an example,[supposing that you have a router and you are sharing your home internet connection among 2 or more computers] would you be willing to paying for $9.99 per 1GB of data for your home router on top of your monthly internet service fee?
That is exactly what the wireless companies are charging for mobile hotspot/tethering; they are charging the customers for sharing data plan as if they are providing additional services for mobile hotspot/tethering.
Yes, I do know that there is a fine print that we cannot share mobile data plan. However, charging mobile hotspot/tethering as if they (wireless companies) are providing additional data service is just fundamentally wrong.

While I agree with you on using wifi tether without paying is wrong, but I am also pointing out that wireless companies are taking advantage & overcharging hotspot/tethering feature. And don't say, "don't use it if you think they are overcharging it."
 
The only reason I responded at all to the last message was because there was reference to third-party wireless tethering in a message that quoted me. I felt I was required to go on record as opposing those apps.

I have grandfathered unlimited data and grandfathered Mobile Hotspot. I pay a fixed fee each at no matter how much I use.

The non-Mobile Hotspot rates were established based on the access by a single Bionic. The Mobile Hotspot rate was established to recover the increased load from additional devices.

It is convenient for some people to rationalize multiple devices on a third party Mobile Hotspot because they have unlimited data. It is false. They have unlimited data to/from a single Bionic.

I entered into an agreement with Verizon when I got my Bionic. I may have preferred a different rate for this or that ... I entered into an agreement.

I am glad you do not plan to use the third-party Mobile Hotspot. I hope others follow you.
