Sprint Class Action??

Check what? In the first month, 3g was working. The first outage happened in the second month, and now 3g is down again, in the third month.

My bad, man. didnt mean to be a @$$. How long did/do the outages last? I've had only had one 3G outage in Phoenix, Prescott, Dallas, St. Lous, LA, and anywhere else my frequent travels take me in my 10 years with Sprint, but it was back up in less than a day.

Last time it was 4 days! I'm at 2 days right now, with no 3G or 4G.
 
I am thinking Sprint deserves to have a class action brought against them for false advertising. The "Everything Data Plan should be $80, not $70+$10 for premium data"

The moniker "Everything data" is completely misleading. How dare they continue to market their "Everything Data" plan for $70, then charge an extra $10 for almost every phone capable of using data?

If you have a 2-line family plan thats $480 over the life of your contract.
 
Pfff... apparently, people are not reading their contracts. In the fine print is a statement where you waive the right to class action lawsuits and trial by juries.

Personally, I think that they cannot actually hold you to that stipulation, using it only to discourage people... but with the recent SCOTUS ruling that corporations can donate unlimited funds to political campaigns, it's a whole new ballgame. There was a recent case where a businessman was being tried for illegal business practices. He totally funded a rival candidate for the position of judge, against the one trying his case. His rubber stamp one and he was left off the hook.

So, don't hold your breath waiting for a class action.

No contract can bind you out of legal recourse. I mean, if a contract says the ETF fee is your now a slave, the contract can not deprive you of legal recourse.
 
My take is Sprint recently(within a year) changed their policy on corporate employee discounts. They no longer apply to the entire bill, only the plan price and recurring fees of $30 or more. So raising the everything data plan by $10 would mean those discounts would apply to those amounts. Making it a fee excludes the discount and hence more revenue. It's a marketing ploy as well.

Thats right. IE false advertising. They still market "Everything Data" for $69.99, even though charge $10 for premium data... to anyone with a "Smart" phone
 
I believe in the free market.

Don't like the way Sprint does business, then leave.

The idea of a class action over this is laughable.
 
Hate to tell you, but telecom can be called just about anything, but a free market, lol. That's like saying the airline industry is free market.

You're free to take your business to any carrier you want. Don't like Sprint's practices, than leave.

Easy solution... Return it and get something else.... The $10 fee SOLVED!

And that's exactly why a class action lawsuit would fall flat on it's ass. You have options to easily avoid it. "Waaaaaa! I don't want to pay!!1!" is not legal grounds for a successful lawsuit.

and I live in a major area.. that they say is covered by wimax... btw, i live in Dallas / ft worth texas.
starting at the beginning of the year.. speeds have dropped.. and has stayed low... there maybe a cause for suite there!!!!!!!!
 
All dumbphones on Sprint still cost $69.99 per month, so there is not false advertising. They are advertising their Everyting Data plan, not their Everything Premium Data plan. Dumbphones are still popular, ya know.

There is no cause for suit. There is no guarantee of certain data speeds in your contract. Voice service isn't even guaranteed all the time. Simply owning an Android smartphone means you will suck bandwidth way faster than someone with a free dumbphone.

2) "EVERYTHING DATA" usually encompasses.... you may have guessed it.... EVERYTHING.

If you are a grown up, and earn your own paycheck, you are perfectly capable of telling Sprint to piss off, and give your money to Verizon, AT&T, T-Mobile or whomever.

Even better, stop wasting time bitching on this forum and go start your own cellular company where you give away bandwidth for free, give unlimited minutes, and have $10 Quad core phones without contracts. See how long you stay in business...

I'm tried, I'm broke need a job and i aged today. There my life story. Nut I difress....

The problem here is that yes, "most people" knew the contract about fees and services some did not. However the whole "I activate a new 3G Androd now because of my 5th broken Hero and I suddenly have to pay $10.00 more? WTF? No loyalty for a customer since 98? Sprint is the still the best value for cost. Period. But considering they are still #3" this new 'fee, premiere change, etc is BS !!!!

WE DON'T need class-action lawsuits unless they were Pro-Bono. We need to use the power of Social Media along with Word of Mouth Marketing amongst everyone to create change. Period!!! We are stuck" in BS contracts unlike most of the modern world is way aheead of the US and it's time consumers, who cant live without their phone(Ha Ha :) ) actually Start to think differentially and ACT!

Well actually I am free to move as I'm on month to month, but many people are not free to move. They would have to pay $150 or a prorated amount. So again, not free.

For some people paying $150 is easy, for others it isn't. And the legal grounds would be the bs fee and how it relates to the tsa not that someone doesn't want to pay it.

If there biz model is they want to charge based on bandwidth used then they should change the modeling of their plans to reflect that in a transparent way. Some ppl, wait for it.................buy android phones and only use them as a phone. Some ppl get android phones and mainly use it as a phone with some light browsing. My fiance has never even gone to the market on her evo. So she should have to pay the $10 fee just because it's assumed she's going to use more bandwidth? It's a sad way for them to generate revenue and is really a reflection of the state of their company. Kind of reminds me when banks went to fee based revenue streams. At least we had the refuge of credit unions.

What I don't do is get an Evo in a non-4G area, and complain that I don't have 4G, but a higher monthly bill.

What I don't do is upgrade, have to pay an extra $10 and call for class action lawsuits.

You don't like the deal, don't sign the contract. Adults should understand this concept.

My free upgrade is tomorrow, I don't want to pay the extra $10 so I don't get a new phone and renew my contract. I am looking at T-mobile which may be a better value prospect at this time. This is the free market.

That is how easy it is.
