Legally he's correct. To have a valid contract you need three things.

1) An offer.

2) Acceptance

3) Consideration

#3 = money or something of value changing hands for that offer. Without it there is no legal obligation.

Not sure the details, but for #3, if you promise to buy the phone (probably needs to be in writing), it constitutes the consideration necessary to form a contract.

Ask sprint to change your upgrade date. It seems they sometimes let you do that.

I was asked to get a GC, but I never got a confirmation number. The rep had to log into the computer to add me to the waiting list (I'm the second person to pre-order at that store).

Thanks for the suggestion. I called customer service and they changed my upgrade date to the 24th. Awesome, dont have to wait now

No call from the Sprint store, they just said to come Friday to pick it up. Not sure why I'd have to make an appt. I asked her how many pre-orders they've had and she said about 10 so I plan on going at lunch.
