I would do what many suggested , get the insurance wait 30 days.(make it 31 or 32 to make it look natural and just get a new phone. It was an accident and your friend shouldnt be wholly responsible. For one you probably shouldnt have immediately taken your phone out after a movie. People tend to walk quick after a movie for some reason and arms tend to flail a little. I believe its the person who is walking with their phone that has to be responsible for any damage.(Its not like driving a car you know.lol)accidents do happen but its not your friends fault you dont pocket your phone.(Not getting on you or anyting but just trying to make you see it a different way. What if their was no phone involved and your hands hit, whos fault would it be than that your hands hit????)

You ought to make her feel better and tell her she doesnt have to pay for another. Man up, use the broken phone, practice on it for a month and get a new one, theres no reason someone has to be out $600. The month will go by fast.

I tried getting the insurance, but they "denied" me - because my account\number was apparently flagged, because I had my Droid X replaced a good 5 times (none of the reasons, were my fault. It was all Motorola.)
Bumping hands, doesn't cost $600. And yes, I paid full price for it.

Did she smack it out of your hand like she was joking or did your hands bump into each other. Big difference!

Both? lol... I was holding it, texting, then she "jokingly" smacked my hand (she claims she didn't know I was holding my phone, now) and... yeah...
 
Me being a guy, not sure that I'd post up that some girlfriend of mine smacked my girly grip on my $600 phone causing it to break. And then I'd start to wonder if she maybe smacked it because subconsciously she hated that I was paying more attention to my phone than to her. Finally, I would totally use this to my advantage if she is hot.....if his know what I mean....brow chicka brow brow

Well driving we are all responsible for what is around us. Lol. But unless it was intentional hit, which you say it was, I wouldn't hold her responsible. Maybe try to fix it yourself like you originally thought.

Well driving we are all responsible for what is around them. Lol. But unless it was intentional hit, which you say it was, I wouldn't hold her responsible. Maybe try to fix it yourself like you originally thought.

What would you call a car accident? Someone runs a red light (they aren't paying attention), and hits you. You are then responsible for the damage on your car?
She was not paying attention to the phone in my hand. She hit my hand. The phone broke. She is responsible.
 
This happened to me on my Incredible. Call HTC. They fixed my Incredible including shipping to/from for $109, and I didn't have to void my warranty by replacing it myself.

Oh and I still have a clear conscience for not committing insurance fraud. :)

But as the guy at Verizon told me: what if the drop caused other problems that may not be visible\noticeable right away? Such as something with the 'inerds'.
I certainly am starting to experience some problems, but I can't say whether or not they are "normal problems", seeing as how I had less than 24 hours with the phone before it dropped.

I have had it restart on me, several apps have crashed many times, the screen's touch sensitivity is starting get more dodgy (possibly due to the cracked glass loosening up), and when I turn on GPS and WiFi at the same time, the phone is VERY likely to reset itself.
 
Get a smaller phone. One that fits in your hand more securely. The incredible comes to mind. And it can be had for a lot less $. Smaller screen stronger glass.

You are operating a car as well as the other person. Under most states you are both resposible now for the damage.(though the one who caused it gets a ticket) A phone is a personal item and if you are constantly holding it and someone accidently bumps you they should not be respnsible IMO. Its not their fault that you are constantly holding your phone and you dont have a good grip on it. There are no laws that say that person should be responsible to pay for the item

But as you say she intentionally hit you so my original point is moot anyways.

A co-worker? Hell yeah I'd make her pay! When I got my GTO brand new, not even a week passed before someone dinged my car door (big nasty gash). Found out it was a co-worker (a guy) of mine and he came clean and had it repainted/repaired for me. Granted he just filed the claim on his insurance, but seeing that gash really made me sick to my stomach. Everything was forgiven after the dent was fixed. I would have her pay you for replacing the phone so that there is no ill-will at work. Being uncomfortable at work really sucks. I'd get it fixed and move on if I were you. Good luck and get yourself a super duper case with your replacement if you should get one, and maybe some of that NFL stick-em stuff.....
