Verizon changes upgrade policy

Material adverse change has nothing to do with the upgrade date changing since the upgrade date is nowhere to be found in the contract terms.


Customers are covered if there is a change to their plan in terms of pricing or a change to their customer agreement.


VZW customer agreement is ironclad on this one since nothing is mentioned about a customers upgrade date and never has been mentioned about a customers upgrade date.

I did include a section addressing the "not in the contract". Specific Fees are not included in the contract, in fact, I believe there is a statement that they are subject to change. But it's been established that when a change in the service which is materially adverse to the customer occurs, the provider is forced to allow the customer to break the contract for a short period of time after the change. This has nothing to do with what is in the specific VZW contract, but is rather a feature of contract law.
 
There is nothing material adverse about a policy change that isn't covered under the contract terms.

Plus when a customer signed up for a contract term of 2 years, nobody from VZW in writing or verbal notified, promised , etc a customer their next upgrade date being on so and so date.


I can tell you now how many people who have VZW that are going to be able to disconnect service and have their ETF waived for being material adverse affected by the Upgrade Date.

Though they don't tell you when your upgrade date is when you sign the contract, they do show you it when you sign onto your my Verizon account on the computer.
 
yes but they dont tell you what your subsidy is at 20 months vs 24 months

a good lawyer and millions in legal bills could get any judge to say that if theyve previously shown you a 20month upgrade date then they have to honor it... but the terms of honoring it are solely up to VZW

you can upgrade at 1 month if you like... but youre not getting subsidized for a new phone

all they have to do for people whos dates have been changed is say the 20 month subsidy is $0.01........ and full subsidy at 24 months

nobody has ever been promised anything specific at 20 vs 24

This is very true, and often in the past if you upgraded early there was an early upgrade fee. Big shocker there. :rolleyes:
 
For those saying their upgrade date wasn't changed and they thought it was suppose to change. Today is the day and mine has been changed.
 
Well, since I have a line affected by it, I'm going to try to void the contract on that line tonight. I'll let you know how that turns out.

Oh, and screw all these ridiculous changes and fees. Even VZW's new 'upgrade payment plan policy' is complete BS because they aren't lowering the price of their plans at all. So essentially, you'll be paying even more for not wanting to re-up your contract with a new phone.

T-mobile has 4G in DC and Baltimore now, so I'll be switching to them in August or as soon as I figure out which phone I want.

You're at 20 months now, so that makes sense. The change to 24 months doesn't happen until upgrades that were due as of 9/1/2013.
 
No update because VZW doesn't allow people to break the contract they signed and get off scotch free.

Sure they do, you just need a good reason. I've see people walk away with iPhone 5s and waived fees. There is a plethora of things that fall into a category that ill allow you to walk away, this just isn't one of them.

I still think anyone in the southwest using Verizon's service is crazy. "Yeah, just drive 14 miles east and you should be able to get that device to activate". Truly mindboggling.
