warranty policy.

hi,
Yesterday I updated my HTC Desire to 1.21 ....
And today I noticed that when i have the screen with more white than any other color (like the notification screen for example) the screen flickers, and it does this with little horizontal lines...

I also realized 2 things:
1. it flickers when the automatic brightness is on and I am inside (so the brightness was set to under 25%)
2. It flickers with battery fully charged once the voltage got under 4.08v, it stopped..

If I am buying a desire outright, does the included 1 year manufacturer's warranty cover things like this?

Also if they do, lets as an example say that the phone develops some sort (any sort) of faults, for example the one above. And lets say that the fault occurs not in a constant but a reciprocal and inconstant cycle, so when I go to the shop to return it, the fault is not present. Will they swap it for a new device? are they obliged to just replace it on the spot? or can they decide to send it to "repair" for a phew weeks?

Also usually after a few weeks, your only option is send away for repair.
