What rom/kernel combo are you running?

That battery % is simply an estimation of remaining battery based on past usage

Keep that in mind. It's not necessarily correct. If you leave it on that 33% will drop real fast

Correct it died really fast and strike from and Mason kernel .15 sbc. But I Ave a question when it fully died it wouldnt charge than I rebooted it than it wast 33%

i'm guessing you mean that once booted up the phone showed it was at 33%. if so it could be that it was charging though the light was not on. sometimes when my phone is completely drained it might flash the red light or it might not even flash at all. but after a few minutes its starts charging.

it is hard to tell from your last post what is exactly happening.

If you using a Mason kernel with Strike it should be Mason EI 1.5.

I already have it but thanks anyways
and ocn I let my phone die all the way and I immediately turn it back on and it was at 33%

ok couple of things:
try and wipe dalvik cache and cache

and or wipe battery stats in recovery.
