I will be happy to assist you with the software available for the HTC Eris. I regret that we have not been able to respond to your concern within our standard time frame. In review of your account, I was able to see that you upgraded to the HTC Eris on 04/26/2010. I am sorry that you were misinformed regarding the software version that this mobile device would be able to support. Currently the most advanced software version supported by this mobile handset is 1.17.
You are correct that there was a scheduled update to the software that was to take place during the first quarter of 2010. This did not occur due to compatibility issues with the mobile handset and the 2.1 software version. As a result this has not yet been completed. I apologize for any inconvenience that this may have caused you.
Verizon Wireless does continue to support older models of handset even as new devices are brought to the market. I regret though at this time, I am unable to provide you with when the software upgrade for the Droid Eris will become available.
Please note that you may return your wireless device, for any reason, within 30 days of purchase for an exchange for the device to another of your choosing. Please be aware you will be charged a non-refundable $35.00 Restocking Fee since the device cannot be resold as new.
Please ensure you return the original box, including the UPC Code, intact with all components (phone, charger, battery, instructions, etc.). All components must be in like-new condition. All returns must be accompanied by the original receipt and will only be granted to the actual purchaser whose name appears on the receipt.
At our discretion, we may decline your return or charge you an additional fee for missing items or items that we determine are damaged or require service. If we accept your return within this period, we will refund your purchase price. The credit for your equipment return may take up to three billing cycles to process.

I took the liberty of further reviewing your account services. I was able to determine, that based on your current usage, you are on the best plan and features for your wireless communication needs.
I make it my personal goal to resolve all of your wireless concerns. I hope I have done that for you today by providing you with an explanation of why the Eris does not yet support the new Android software. I was able to explain your options to be able to return or exchange the mobile handset for a different model. We appreciate your business and thank you for choosing Verizon Wireless.
