Sprint Class Action??

You are hearing what you want to hear. What do you think would be the basis for this lawsuit?

Yes, I'm sure somewhere, someone is trying to start a class action lawsuit against, Sprint. I'm sure there are people trying to start class action lawsuits against Verizon, T-Mobile and AT&T as well. That's how things go.
Two things about this though, I really doubt anybody who voluntarily signs up for an extra service charge would win a lawsuit that they are being charged the the charge they agreed to be charged.
Also, class action lawsuits usually don't do much for the people suing (monetarily at least). Most of that money goes to lawyers, remember the Music Industry one? People got a free CD voucher (not even cash), and they were paying about $5 too much per CD for about 10 years.
If a company ever screws you over to the point where you actually sue, its sometimes better that you were one of a few that got screwed if you're looking to get rich.

Pfff... apparently, people are not reading their contracts. In the fine print is a statement where you waive the right to class action lawsuits and trial by juries.
Personally, I think that they cannot actually hold you to that stipulation, using it only to discourage people... but with the recent SCOTUS ruling that corporations can donate unlimited funds to political campaigns, it's a whole new ballgame. There was a recent case where a businessman was being tried for illegal business practices. He totally funded a rival candidate for the position of judge, against the one trying his case. His rubber stamp one and he was left off the hook.
So, don't hold your breath waiting for a class action.

Just because it's in a contract doesn't mean it is legally binding. If a contract says if you don't pay your bill, they take your firstborn son, doesn't make it legal for them to do so.
That said, even IF there was a class action, and even IF it was possible for it to go anywhere, and even IF it did win, it would be years, and all those involved would get checks of like, $3.00 for the effort.

Not even possible. You signed a contract saying you'd pay the $10, and it wasn't under duress. You still have ~30 days to exit if you don't like the fee.
Exactly. It would be a different story if they did this AFTER you bought the phone and selected the plan....You signed up by your own free will and were made well aware of the charge....thats like me creating a class action lawsuit against my cable provider for charging for HD.....

Are you effing kidding me? If suing Sprint for this is something you're considering you need a kick to the nuts/lady parts. I've heard a lot of stupid crap already today, but this takes the cake.

The only way a class action could take place over the $10 fee is if you could prove that somehow Sprint has monopolized the market and is FORCING you to pay the $10 fee. Or if it broke some antitrust laws in the process of doing the fee. Which it doesn't on both counts.

I could see a possibility, if people were not getting the benefits/performance which is part of the reason/excuse for the charge.

You guys are acting like crazy things like this don't happen all the time. If you can break into someone's house to rob them and you hurt yourself, then you can sue the homeowner then why couldn't something like this happen. These companies get sued all the time for things that are already in the contract "unfairly". Not saying I agree or disagree with it, just saying it can happen.

Sprint really needs to come public about the fee. I called today and asked why they were charging the fee and the girl said it's because of more data being used, access to 4g (which you may or may not get), access to HD pics (which are resized anyway before sending), multitasking abilities, other apps that run a lot of data to keep the phone running smooth, and because of a big screen. Are you serious. I told her the hero runs the same apps and does the same things but it's smaller and obviously doesn't have to speed the Evo has. The fee is not being justified by anything at all. They should have just called it a 4g fee but then most people wouldn't bite because most people wouldn't get 4g in their area. She also went on to say that at&t just changed their plans and now there is a cap of 2gb and that Iphone users are being charged a premium. Which leads me to believe that they think since at&t can charge more, why can't we.
I am not arguing the fact of the fee but sprint can't even get the reason for the fee right. I have heard three different answers from different reps. People have the right to be mad about it. This is a forum and your going to get different perspectives on things. It's easy to say just get another phone but this is not about the phone it's about the fee. If someone wants the phone and finds the fee to be wrong, that's their perogative and no one should say oh well, move on.
I probably will get the phone and have to pay the fee but lets not attack people for their views on the fee. Until sprint comes public and really explains it, these threads will continue to strive.

Coming from Verizon, I don't understand why people are complaining about an extra $10.
You still pay less than what Verizon owners pay and get more for your money. I would love to pay what you all are paying now with everything that is included.

They do charge extra for tethering on our end, and it's not even wifi tethering.
I see your point about being charged extra for something that it seems Sprint doesn't even know what to call just to make more money. But costs in general seem to go up and not down.
Anyway, just trying to give some perspective to the costs Sprint owners are paying versus what us Verizon guys pay.
Makes me jealous. That and you're huge screen.

Exactly. It makes no sense. Of course coming from Verizon or At&t your going to take the fee no problem. You guys have been paying more then you should for a long time. What's $10.00 when you have been paying $30.00 more. This is exactly why sprint hasn't said anything. There push is to get people from other carriers that are paying to much. Someone came up with an idea of charging more in a board room meeting. They analyzed other costs carriers charge and said people will jump to pay $10.00 when they are saving so much with us. Veteran sprint customers such as myself being with them 7 years have a unlimited plan, and now we have to pay more for nothing extra. Justify that.
