Sprint Class Action??

Guys - I haven't gotten the EVO YET. I have seen NO JUSTIFICATION from Sprint for the $10 - other than a Luxury Tax. My suggestion - I'm not happy about the $10 - but, if here's the answer to the class action - don't buy it.

MY issue right now is my upgrade date. If I can get SPRINT to budge. i would do it.
 
I really don't see a reason for a class action. Its not like they changed the plan after you agreed to something else. When I got my phone they were quite clear in mentioning the extra $10 monthly charge in fact it was mentioned several times before i signed the contract with Sprint. How can you sue if you knowingly signed that contract? I mean I wasn't held hostage or made to sign that deal at gun point. Give it up folks. In fact before my activation was completed I got a call from Sprint and they laid every part of the contract down even the approximate monthly bill with taxes and AGAIN she mentioned the $10 fee.

What if they add another charge, is it ok as long as it's not as much as the competition?
Yes, it is perfectly acceptable, not to mention legal, for a business to raise their prices. You can either pay them or not. It's nothing to launch a lawsuit over.

The way class actions work is the lawyers end up getting paid by Sprint.

FCC needs to take action too. Selling 4G when it aint available... Re-tarded.

It's not re-turded, it's greed. I don't care if Sprint has the cheapest plan in the whole freakin galaxy or 5th dimension. Why are you willing to pay for something you're not getting? "But you'll get 4G in the future". Then I'll how about I pay you $10 when it's available?! "But they need the money to expand their system". Ask me if I give a donky dork about their need for money. By the way, it's not $10, it's $10/month... forever... until 5G comes out and the shiites get recycled again.

I will probably get the phone anyway. The 15% student discount will ease the seething bitterness.
 
I see both sides of this. The $10 fee is kind of a bummer for someone like me who is in a large metropolitan area, Orange County, CA, and yet I still do not have 4G coverage. However, $10/month so that they can continue to build the 4G network out, I am more than happy paying. I just hope I don't pay for 4G 'premium service' and then it doesn't get released in my market for another 3+ years.
 
What I am going to do about the $10 fee is simple. I have two Evos on my 5-line share plan. After about 25 days, I am calling customer service and/or retentions and say that the one phone my GF has doesn't use much data and she is thinking of swapping it out for another phone because it isn't worth paying $10 in addition to the $20 share plan charge. Since I am already paying a $10 fee for one Evo, I bet they'll waive the other $10 fee. I'll let you all know....
 
Quit complaining and go to another phone? You knew about the fee before you bought the phone, and even if you didn't, its stated in the contract you sign when you purchase the evo. I was told 3 times about it before purchasing the phone on that Friday.

Let me clarify.

1. I did not buy a new contract or upgrade. 2 weeks before I had upgraded my old phone to a Hero and under Sprint's 30 day money back/exchange warranty I returned the the Hero to exchange it for the EVO at my local Sprint store.

2. At no time did anyone at the sprint store inform me that there was a mandatory add-on to my "Everything Data Plan" of the Premium Data Pack for $10.00 a month.

3. The folks at the Sprint store told me there was 4g coverage in my area Glendale, CA. Found out later NOT!!!

Called Sprint and was told the extra monthly charge was not for 4g coverage (Which there is none here) but "For the EVO experience, the faster processor, the video calling and the extra things it could do. WTF??? I think I have a right to be unhappy considering I was not informed of the extra charge before I exchanged my phone. I could understand if the extra charge was for the 4G coverage but Sprint say's it's not. I'm paying the extra 10.00 a month for using a cool phone with cool features. This to me is just wrong and unfair. Is Apple charging it's customers a monthly fee to use the new iPad because of the cool features? NO! Do you pay a monthly fee to Best Buy for that new Blu-Ray player that can Stream via WiFi? NO!! Does any other Wireless phone company charge you extra per month after you buy the phone and the plan just for the "experience" of using it? NO!!!

So you did no research on the phone beforehand? You have been on this forum since may and have probably looked at threads in the HTC EVO 4g forum before you bought the phone, and you did not see the threads over the 10$? bullshit.

I find it hard to believe that the guy at radioshack that knows nothing that told me 3 times that i have to pay an extra 10$ a month to told me, and the sprint guys did not tell you. Did you not listen? Also, its in a contract you sign for the new phone..so i am calling bullshit, yet again.

Easy solution to all of this above..get a different carrier. Oh wait, you are locked into a two year contract that you agreed upon, legally signed and you are still bitching. That sucks, get over it.
 
Am I not already buying the faster processor and the bigger screen when I pay for the phone? I wouldn't mind if they raised their prices across the board.
 
First post, new evo owner as of Wednesday.

I agree that we signed and agreed to the $10 a month charge. But that still doesn't make it right. The fact that they can't explain what the charge is for is pretty stupid on thier part. You would think they would have found a good legitimate excuse to charge the extra $10.

But again we agreed to the fee even though we really don't know what it is for. So what does that make us?:eek:
 
How about suing Verizon and AT&T for charging and extra $29.99 on top of their plan, just to get unlimited data usage on a smartphone and leave Sprint alone?
Let's compare:

Sprint: $129 family plan with 1500 minutes, unlimited everything plus GPS nav on phone = $129 plain and simple, plus a lousy $10 for 4G on a cell phone which is cheap and worth it IMO, that's nothing compared to $30 extra Verizon charges to get unlimited 3G data on their "smartphones"

Verizon: $90 family plan for 700 minutes + $9.99 for the second line plus $29.99 for each smartphone (X2, me and wife)= $160 (no GPS nav, no 4G)

I'm sick of Verizon raping me every month, that's why I'm switching to Sprint real soon (EVO) and so is my wife (HTC TP2), I heard AT&T also works like Verizon with their stupid $29.99 extra to use a smartphone, but I don't know about them, the only thing I know is that their phone calls drop and is unreliable.
 
well, what if they start throttling 4g users even after paying this $10 "premium data user fee"?

will that be grounds for a lawsuit?

supposedly this fee is so we can enjoy all this unlimited data (3g or 4g) and access to 4g speeds. if those 4g speeds are being throttled down to subpar 3g speeds, then what is that fee for?
 
Exactly. It makes no sense. Of course coming from Verizon or At&t your going to take the fee no problem. You guys have been paying more then you should for a long time. What's $10.00 when you have been paying $30.00 more. This is exactly why sprint hasn't said anything. There push is to get people from other carriers that are paying to much. Someone came up with an idea of charging more in a board room meeting. They analyzed other costs carriers charge and said people will jump to pay $10.00 when they are saving so much with us. Veteran sprint customers such as myself being with them 7 years have a unlimited plan, and now we have to pay more for nothing extra. Justify that.

The 3G plan is not unlimited and was not unlimited, its capped at 5gb, the $10 extra takes away the cap as well as access to 4g. Not that it matters about 4g, we only have 3g and the evo is faster than other phones, i think its the processor, just process the data faster. I am also using a lot more data, this week anyway, will have to see how it changes once i settle into the phone and not downloading a ton of apps, but I got mine on Saturday afternoon and have used about 1.5gbs of 3g so far, if that trend holds i would use 6gbs in a month. The att plan would cost about $65 for that much data 2gb($25)+4gb @ $10 each= $65, ($450 with the lower plan if you don't notice your usage and change it to the 2gb option, lol)
Verison also caps 3g at 3 to 4gb iirc, the rest of my family has vz.

The sprint plan seems like a good deal to me.
 
The problem is NOT that we agreed to pay the fee and now we don't want to. The problem is that when I purchased my phone, I was told the fee was for 4G service. Great! Excellent! That's part of the reason I want the phone! The problem is that they are not providing the service that they are charging me for. It is a very basic breach of contract. If they provide me with 4G service anywhere near my metropolitan area, I am more than happy to pay the stinking fee. They need to nix this charge until they are actually providing the service.
