Help Aftermarket headset issue

Bought an aftermarket headset/handsfree which fit into my ears better, they sound fine apart from when I push them all the way into the phone -so they 'click' in as normal, the vocals in my music sound as if they are under water!? Only if I pull them out slightly (so they aren't locked in) does the sound become normal. I thought all the jack plugs were the same? Any ideas?
 
unfortunately there is not actually a standard and so when it comes to phones with an extended socket for inline controlls they can cause problems

does this headset have an inline remote?

yes mate it does & that seems to work ok, it is only when like I say, the plug is pushed in all the way as normal? It (the plug) even looks the same as the original HTC one which is wierd! Guess I'll have to take them back & argue my case - pity. Thanks anyway.
