Call VM to try to get a replacement. You may need to activate it (can always activate back to your existing phone later). They may have a record of when it was first activated to see when it was originally bought. Actually I'm pretty sure it's within their 1yr replacement policy because the MT only came out mid-July.

It isn't possible for the phone to be over a year old. It came out mid-year.
I don't think they will replace a phone because it has a scratch anyway, especially if you bought it off ebay. The 1-year warranty is suposed to be for manufacturing defects/issues, not because someone scratched their phone up. I would be surprised if they replaced it over a scratch, but I could be wrong.

Actually, if I were a betting man, I would put money down on VM replacing your phone. Some people were posting that they smashed up their phones (i.e. screen smashed up), called VM, and got replacements. It never hurts to try. The worst they could do is say no.
