Is Sprint selling $300 REFURBISHED Evo V's?

It seems to me that Sprint may be selling refurbished Evo 3D's as brand new Evo V's.

I say this because I picked up a 2nd Sprint branded Evo V from Target and the first things I noticed after flipping it over is that the camera glass has scratches and under the cover where the battery goes was all scratched up.

I'm pissed...for $300, I ought to be receiving a BRAND NEW device...or they should warn us.

Needless to say, this evo is going back.


Shame on you Virgin/Sprint...that is very dirty business.
 
this has been common knowledge since people starting buying this phone. i mean i dont have an issue with it saying sprint on it and neither does a lot of people on here. i works as it should am i correct, if so stop complaining. ps what about phones that are the same phone but called something different on on carriers.

I never knew they were selling refurbished phones. No need to be so harsh. He's just sharing his findings. Lol guess I'll make sure to get a virgin branded one.

It's common knowledge that HTC Evo 3D's for Sprint have been flashed for Virgin and resold as an Evo V, but it is not common knowledge that they are mixing in the refurbished Sprint HTC Evo 3D's....big diff.

I have zero issue with a sprint branded virgin phone that's been re-flashed and re-packaged...I do have an issue with receiving a refurbished phone(especially a noticeably refurbished phone).

I would take it back right away.
It may have been damaged in other ways besides being a refurb. Accidents during manufacturing or re-flashing does happen.

I think stitchbass misread your post. They aren't selling refurbished phones and I think yours was just one that got past quality control unnoticed.
 
If they are refurbished which I doubt it is illegal for them to sale them as new phones.I'm pretty sure yours just got damaged during the whole shipping, flashing, and repackaging process.
 
Just type ##clear# and you'll see for yourself that the reconditioned status will show as no. And yes it's against federal law to sell refurbished items and not informing the consumer in advance.

Wish I would have known that trick before I returned it as I deff. Would have checked.

I didn't know it was illegal to sell refurb. as new...I just figured they were pulling a fast one on consumers.

Either way, the phone I had bought should NOT have been sold as NEW phone.

FYI- I returned the phone without ever even turning it on...I posted this thread and then returned it immediately after posting this thread....I was to pissed it was all dinged up to start. I just wanted to warn people that this could be a possibility as my 2nd evo v seemed to be refurb. quality.

Apparently it's illegal to do so unless their is some loophole they took...

I kinda wish I would have turned it on at least...MAYBE it was one of the mystical un-flashed phones I've read about on here:rolleyes:.
 
Who knows maybe during the re flashing process it got dropped and the tech just let it go without saying anything?

It's actually pretty easy to see that. Some entry level employee hired to sit and flash phones all day accidentally drops it and it gets scratched up. Being a relatively new grunt, he worries if he reports that he damaged the phone that he'll be fired, so he quickly repackages it and hopes no one notices.

No they aren't as it's HIGHLY illegal to sell anything other than new as new.

That said with the Anker 3500mah batt I haven't had any reboot troubles beyond that one time a couple of weeks ago... likely either "loose" batt.

My 3500 mah seems to have come loose one and rebooted the evo and then lost all pin contact which I initially thought meant dead batt -> recharge which didn't work until I opened and reseated batt, although no problems since then either.

Also seems to have heat problems. I got the high batt temp yesterday after using it outside for a bit alot of wifi & 3g and it wasn't quite as hot as the day before, only 92F or so and cooling rapidly(threatening to rain). (I suspect that some of the new apps that I was trying were nailing 3g/wifi but I haven't gotten around to investigating as I took the lazy way and rebooted before checking running services... after letting it cool down in AC.)

Exactly my thinking, probably some students making minimum.
 
So I wonder what sprint does with all the returned phones even when there is nothing wrong with them save for some cosmetic damage to the evo v...so technically if sprint determines that the phone is not damaged as a return only prior owned, does that still constitute a refurbished phone ? I wonder..
so if someone returns a phone to the sprint store only because they didnt like the phone and sprint tests it, repackages it, and sells it as new....loophole for the refurbished law...so there's the possibility that sprint is selling phones that were a customer return...and also so strange that the independent dealers did not get this phone....i mean how would it look for the virgin mobile dealer to sell a phone that has sprint on it...where are the VM branded phones....? So how are they supplying VM branded phones to the reviewers on like PC-Mag and so forth....:banghead:

This is why I don't buy direct from Virgin or any carrier or manufacturer.


When you send in a broken phone, they send you back on that has been refurbished or sent back with no real issues. See, when you buy at the store, they only have new phones in stock, so if you return it, they can only grab another from the shelf. When you return it to Virgin, Sprint, or any carrier or manufacturer, read the terms, they do NOT guarantee you a brand new phone in return.

So you buy a brand new phone and use it fails after just a day or two, they don't have to send you a new phone, you sent them a used one, they can send a used one back. It might be brand new if they have no used ones to send, or it could have been used for 6 months.

The dot com I worked for did this with our exclusive items, they also didn't guarantee a time frame for return... and some of the return times were PATHETIC. If you can't exchange, get a refund and buy another.
 
Might also be NOS (New... Old Stock). The Evo 3D could have been shuffled around in a dirty warehouse for a year before being sold and repackaged by VM. It's still considered new... but sure doesn't look it.
 
If the phone was ever activated it can't be sold as new.
No they can't. Once it walks out the door sold as new it MUST be sold as open box or refurbished.

NEW means NEW, not kinda sorta new, but actually really new, never opened, never used, etc. IANAL but I'm pretty sure that the legals distinction is VERY clear and pretty much amounts to my kinda sorta summary in a more legally binding/unambiguous fashion.

They're probably what we get sent as replacement phones under warranty or for other reasons, which IS perfectly legal as long as they don't claim to be sending you a "new" phone.

Every single company does this.
