For your information let me tell you that making gingerbread ROM is not easy.
I am working on it but due to my exams I have paused the work.

AOSP is comprised of Apache 2.0 which is copy free licence and vendors can choose to copyright their android modifications like Touchwiz/sense/MIUI/Timescape .
and GPLv2 in which the vendors have to distribute source if we demand or request it .
The vendors or distributors have to release (legal obligation) kernel source which is Linux comes under GPL .

Micromax cant sell linux based devices (not just android) if they wont honor the GPL .

I do not think the AOSP states that the handset manufacturers are bound to release source code of their android handsets to the public..

That's why it is called open source.

Android clearly states that it is under Apache 2.0 license except the kernel patches & kernel source. Which is indeed based on Linux kernel source. If MMX requires they can copyright other parts, but in case of linux, they have to provide it under GPL2.0 or higher.

If required, they can remove propitiatory firmwares from linux kernel,but rest they have to release in GPL2.0. Which indeed means availability of the source code. In mail they have replied they are not releasing source as they made some modification to the kernel. As per kernel licensing, they have to contribute back to linux kernel or release the source as a fork.
