I think it's weird that some of you guys with 1-2 month left for your NE2 are getting so much pushback. I bought my Thunderbolt the day it released, and while I've had all sorts of headaches with my Thunderbolt (I even had them cancel my voice plan at one point by mistake when I went back to my old TP2 which proved to be another headache) they were decent enough to upgrade me to a new phone. Granted I hate that I spent $300 on the bolt when it came out and now I'm back in another 2 year contract and another $300 lighter. I'd keep bugging them and if your phone is problematic and under warranty, make them send you a refurb.
The key is to find some leverage against big red. Hell go to AT&T, Sprint, T-mobile and tell them that you have a couple of months until your contract expires and if they offer any early termination fee credits if you leave your current provider. Sprint offered me $200 in credit if I left Verizon and I told Verizon back in the spring (I really didn't have any intentions of leaving Verizon because Sprint's 4G is laughable at best). They had no problem offering me an upgrade if I remained with them.
