So my question is, who decides that the phones are not in violation? Customs? crApple representative? ITC representative? what is the process? I'm sure it's complicated beyond belief with so many attorneys involved.

So far as I know, the court applied specific criteria and customs is using that.

Customs actually has processes for more stuff than you can imagine. I once got a walk thru on how they looked for pirated Disney images on imported products (plates, clocks, etc etc) and after about a half hour, I cried uncle. The agents just laughed because they were just getting started.

(I've dealt with them often on electronics imports for my business, so we had time to kill one day.)

Anyway, the process is supposed to be straightforward, but even the most straightforward customs process is very time consuming.

And yes, without a doubt, attorneys from both sides are there arguing and making customs officials lives a living hell.

Thanks EarlyMon. Probably not a good sign that I was sensored on first post.

No one has anticipated the receipt of this phone as me. Ok, maybe not, however after a long week in Mexico a I managed to get my OG EVO lifted in baggage claim area on my return. I received that phone day one almost two years ago. I know there a lot of us out there in the same boat but I am rocking a palm per since May 2nd. I told myself surely I can make it two weeks until my new EVO lte gets here. You know the rest so I know disappointment but the phone is just worth the wait IMO. Oh yeah ordered a replacement OG EVO at 9am this morning will be here tomorrow. Life is whole again and will wait for my new phone to get here.
 
so what are we gonna do about it folks?????????? there are some very intelligent and forward thinking people on these android forums, and plenty of supporters to boot, including myself. We the people have all the real power!!! let's do something!!! we're fortunate to have tech and information on our side. can't we draw even more attention to this in some way and accomplish something that supports how we all apparently feel about apples/patent office procedures. I mean how many of us together would it take to get national news attention???? petitions...email...what can we do to utilize our power????? don't get me all fired up just to waste e ink on how messed up this all is....let's act. know a news reporter??? know how to throw up a site with the quickness???? I don't have all the answers of course but I'm def willing to participate if I can't come up with an idea myself....and besides, wouldn't it be fun to see what we could do????? seems to me like having issues but not voting or something....c'mon all geeks, nerds, techies, cool people, etc. let's toss out some ideas. I'll post when I think of one...

  • Patents need more strenuous examination before being granted
  • That a country that allows a patent on how to make toast is a disgrace to its citizens
  • Patents that constrain trade rather foster innovation ought to be thrown out, and that you, the consumer, are being targeted by a predatory company
  • Companies like HTC, with a significant US workforce, ought be afforded protection for things they developed but others patented
  • You want satisfaction

I think the question here "what is the proper course of action?" Should buyers keep their orders to show unwavering support for Android and htc, or cancel their orders in hopes of pressuring sprint into something (offering some firm of consolation, dumping iphone, whatever, not sure). Personally i'm sticking with it to show my unwavering support, a I suggest everyone else does the same to show apple the futility of such *****e baggery.

You don't really think Sprint would dump the iPhone, do you? They spent a boat load of cash to get the iPhone in the first place. It's the best-selling single phone on the market, last I checked (and if not the most, one of the most). I know Apple is acting like a jerk, but Sprint won't dump the iPhone unless it stops selling.

And as far as Sprint/HTC giving something to consumers: This is not HTC's fault nor Sprint's. Because of that, I wouldn't hold it against either if they chose not to give anything out by way of apology. However, if they chose to do so, I would see it as a sign of a company that cares enough about its customers to go above and beyond even though it's not their fault. And that's a company I would do repeat business with.
 
Called sprint once again today. As always, take it with a truckload of salt, but the rep. I spoke to says the launch is still planned for Friday, and I was very specific to ask if this was still the case even in regards to the patent dispute. If others could call in see if there are any other answers floating around, it'd be greatly appreciated.
 
Easy guys, everyone is upset, me included ;), getting angry at eachother won't make Sprint or customs release the phone any sooner.
Blaming someone won't solve the problem, so let's try and stay positive. :)

I'm going to get to flashing a new ROM on my OG, its still just as fun.

What will the rest of yinz be doing in the interim to pass the time until launch?


Exactly. I just flashed the new MIUI ICS on my OG. So much fun.:D

Great, now would it be more impactful for one particular congress person to be the recipient of all our android fury?? seems like that would garner more attention than fewer emails to multiple persons....ya think???
 
Just got off the phone with the corporate store here in St. Louis and they have not heard of any delay and still plan on opening early for launch on Friday. Either way, I've waited this long, I can wait longer if need be. No biggie.

can we put those bullet points in an email to a congress person and everyone send the same email. we could start a thread to account for each person successfully sending their email. that way we have an idea how many are being sent or something. would take less than a minute to copy/paste and send...
 
Thanks earlymon! I really think we should all follow through with this!! If someone creats a petition please post the link here so we can all add our input to it in 1 petition not a million 1 petition is better with a million voices vs a million petitions with few voices!

edit....cool looks like Sauske is starting it...if possible the bullet points from earlymons post are good IMO to include..some if not all

I agree, as I already had mentioned such things. 1 giant petition would be better then a thousand small petitions so please folks 1 petition with all of us in it would be easier, and more organized!

If you can come up with a nice piece and add those bullet points, I will add it! And it's directed towards ITC!

Is there any way for US to all join in and voice our thoughts and opinions on one giant petition?

Also if we get enough voices in on this maybe we could direct the link to itc oh wait that violates apples patent oh well... Well if we send the itc a nice professional email showing our concern as American citizens and send them the HYPER LINK TO THE EMAIL maybe they will take a hint !! Not likely but It's worth a shot ya know? :-)
