Verizon shipping new Eris's (Erisi?) with Leak3/Official 2.1 now?

I just got my "Brand New" never opened replacement phone yesterday and it came with HBoot 1.49, which is the Leak 3 Hboot number. So either someone over there was like ooooo a shiny new phone with the plastic still on, lets put Leak 3 on it, or Verizon is shipping these babies with new Hboots. I dunno, I guess we'll see if Verizon ever releases "MR3"
 
It could very well be that leak 3 was the file that they do the initial flash with before it leaves the factory.

Seriously. It would put an end to @VZWSupport's claims that "if you installed the leak, you voided your warranty," and it would also mean that you're likely to receive future updates (or at least have a valid reason to be angry at Verizon if you don't).
 
This will also mean that those who thought they were gonna get a replacement to root their phone will be very disappointed.
 
Verizon says that loading the leak will void warranty and then they go sending out "like new" phones pre-loaded with the same software.. I for one would be pissed. If they are gunna be sending people these phone, at least give us a way to go 2.1leak to 1.5!
 
maybe someone else who installed the leak returned their phone... VZW wiped the data... didn't flash a new OS... and then sent it back out the door?
 
With the phone off, hold send and end. Screen should pop up with hboot version on second line. On some phones it might be volume down and end instead.
 
Well, well, looks like leak v3 is the official software now. So now how do they update those that got the OTA's HBoot?
 
I got a brand new eris yesterday and its HBOOT is still 1.47...maybe since so many leakers are getting refurbs the OP happened to get a leakers phone that had a hardware issue fixed...
 
Just as an aside, you may want to differentiate between brand-new and refurbished. It is a totally different ball of wax if they are shipping new in the box phones with hboot. 1.49. A refurb is likely a leaked phone that has been turned around without a reflash to 1.5. In that case, you will have the same issues that the last owner had.

Did you get it from verizon or was it from htc? Also were you on the Irc earlier talking about it or does another person also have this problem?
 
I received my replacement yesterday (only took one day!) and it is a refurb with 1.5 and update waiting with hboot 1.47.
