Date you ordered and received the phone vs. "will ship by" date

My receipt does state such. If necessary, testimony of subpoenaed individuals will also support this. Also, you can't change the terms of a contract after it's entered into unless all parties consent. I bought a phone on the condition that it would be shipped on or before tomorrow. Verizon did not reserve the right to change that agreement.

I was concerned about this when I ordered in the store, so I made them print out a sheet that detailed the account information and the order details, including "Will ship by: 6/25/10". I also pressed the point verbally several times, and received verbal confirmation back.
 
It's like a child sitting on Santa's lap and he Santa says.. we have under estimated the amount of children wanting toys this year and then the elves have had problems making some of the gizmos that make your toys work. It looks like we are looking at least a five day delay this year. Now if that delay falls on or over the thirty first or first of Jan we might have to add another eight days to that delay. I'm sorry for any inconvenience this might cause. The child says.. but Santa.. I talked to a kid who got his goodies early and I clearly heard you tell the kid in front of me that his toys would be there the 25th as promised. And santa looks at the kid and says... that's right kiddo.. you're hosed!
 
If you seriously file suit, you will become a great example of abuse of the legal system. At first the tirades were funny to me, now I am sad to see a bunch of people possibly using the legal system to whine about a PHONE being a week late.

Goodness.

I do hope everyone gets their phones quickly.
 
Pena, could you please make a vid when you serve this citizen's arrest warrant?

we would all enjoy and laugh at you getting thrown out of the store on your ass.

Thats a little far, I don't agree with the action, but I wouldn't say anything like that. Though I do think it will be hard to win, I don't think he would get thrown out of the store.

I am seriously upset, and I do believe in everything I'm saying and that this Incredible fiasco is totally illegal. If I were going to be in Phoenix tomorrow I would still serve the arrest complaint in person, and I will still be faxing it tomorrow. But do I seriously think the store manager will spend tonight behind bars for his role in this crime- NO!:D

I am thinking about jumping ship to the X as well, but I would like to see more reviews. Too bad the VZW reps wouldn't let me have the display Incredible when I asked.
 
Pena, I completely understand your anger with Verizon and their lack of compliance and what it comes down to. However, a citizens arrest, really? The poor VZW manager probably has 2 kids and a mortgage... lol. There's no reason to get the dude fired, he's just doing what corporate told him to. Seriously though, we all paid for our phones and we are all waiting. Most of us longer than what we were told. Its the matter of principle I know, but just chill out...
Btw... I really hope your a lawyer cause I'd hire you after reading all this lol.

Be that as it may. The Verizon executives probably have kids too. When I'm older, I will as well. I would not tolerate a company ripping off my children in any way, nor will I tolerate one ripping me off. The Verizon store manager has my contact information and could come to terms with me personally. If he doesn't by tomorrow afternoon, I will not spare him from the legal liability spiderweb he is about to become tangled up in.
 
Hey, at least our antennae won't short out and kill our signal when we hold the phone in a normal fashion or have odd yellow blotches all over the screen in addition to random stuck pixels...

I'm ok with ensuring a quality product is delivered as opposed to just getting it out to the customers ASAP without regard to quality control.

God I hope I didn't just jinx myself...
 
we're all people. we have an inconvinience on our hands. penascense is responding to this by exacting his own inconvinience on verizon to "teach them a lesson". trying to get even with each other does not make the world go round.. this is why we continue to have wars :(

Hey RM! Well with my Ship By date being 6/28 and all the chaos that has been surrounding the shipping of everyone's phones, I wouldn't even attempt to hold my breath that it will even ship out next week. I used to be hopeful, but now I'm just being realistic! :p

Agreed I think what everyone wants is a reply with a ship date that is as accurate and consistent as possible - Lets hope that Verizon and HTC get things back on track quickly for everyone.
 
Good Moaning Everyone!

I am thinking about picking up a moto droid for one of my other lines and then returning it when my dinc gets here and forgetting about this all. Heck maybe I will even like it enough to forget about the dinc.
