I wonder if this is a case of Sprint not being happy with BB for announcing a definitive date before they did, because it's not set in stone, they wont allow them to sell/distribute before they get the pre-orders delivered or "don't you dare announce this before we do."

Its pretty clear that they have went around the patent.. which is a jokee ( for u.s. versions anyway).. and its obvious that the devices have been in the us for a couple days at least if not longer.. you cant tell me they all arrived at our shores and then were stopped.. so after april 18th or whenever this patent ruling went into play HTC should have known this would happen as a prelim thing.... and should have been better prepared..

before all of this may 18th mumbo jumbo i was expecting mid june or later so im fine with waiting.. no way im jumping ship on this one... but man what a TEASE lol:banghead:
 
Forget the OTA nonsense.

If they weren't in compliance, the courts would not give them a do over.

They are in compliance. They have been in compliance.

Compliance is such a non-issue it's not funny.

For those of us following this without a break since it went to court last year, there is absolutely no question on this.

I am not speculating. The news blogs have posted pictures of pre-April 19th One X screen shots repeatedly showing compliance. This thread is full of those links, I gave one a few days back.

They didn't try to sneak anything in. Period.

There is one reason only that this got dragged out.

Apple's legal team.
 
And by the way, since many haven't been following this, the original order was a complete surprise.

The judge in the case made his ruling with his own clerks dumbfounded, as their research showed that HTC wasn't in the wrong in the first place.

HTC ships lots of phone models into the US.

The ruling affects each and every one, not just these new models. These phones didn't exist and weren't even announced at the time of the ruling.

One more time - there is no compliance issue, HTC didn't try to sneak anything in, neither HTC nor Sprint cut corners, and there will be no OTA.

I believe that you'll find that the iPhone doesn't implement the patented feature at all.

Apple took HTC to court with a basket of patents that they claimed were being violated.

Only this one stuck.

The patent never mentioned mobile phones, that is Apple FUD. Microsoft has been violating this patent since 1999.
 
oh yeah well what about androids notification pull down feature my hero had that while the iphone was still in its awkward 3gs diaper stage. lol... and somehow it magically now has this feature..

The full story is going to take time to come out.

The inspection was expected and fully prepared for. It was always going to happen.

It ought have passed. The only way that it got dragged out was someone objecting.

There's a reason that during this same timeframe, the court has ordered Apple and HTC to sit down together this August and hammer out an agreement.

Go to a major port. Look at the volume of containers flowing in daily. Talk to people who work in customs.

This country has bigger concerns over what crosses our borders than some lousy cell phones, and customs staff is limited.

The court decision sending them to the table is very definitely related to this nonsense that Apple started.

They were no attempts to legally protect that feature.

Apple has been free to copy it.

How about Twitter integration?

Apple is claiming that their recent tightly coupled Twitter feature is unique to them.

Same thing as the notification bar.
 
The fact that you say apple doesnt even use that hyperlink in the iphone anymore just solidifies the fact that this is all BS. Hopefully we dont have to wait until august to get our beloved evos lol... Maybe tomorrow we will get a decent statement from sprint or htc being as is was the orig date... and not these generic playin' it safe ones.

I curious, though android is a free source project, Google does in fact patent its advances doesn't it?

With Apple's arrogance in patenting things that are clearly not theirs, I wonder how Google protects there idea's?

anyways i have been just as on the edge of my seat as the rest of you. but come on now. all this stuff going on is no reason to leave sprint. i LOVE the fact that htc and sprint get together every two years to make a bad mf'in phone. i love that sprint has the cheapest plan. and that htc obviously has some loyalty to sprint to make the baddest phones for them after selling at&t and verizon the crap. cant talk shit. bc i think that yeah even though sprint knew about this, they were really trying to help us out. the original release date was june 10th right? i think they released early bc they WANTED to get us the phone before this apple patten stuff went down. but their gamble lost. and what is everyone doing? killing them about it. not cool.

like i said ive been waiting for this phone since it was leaked as the 'kingdom'. i doubt any of you (esp since most of you have the 3D) have been waiting as long. i am sticking with sprint, and sticking with htc, and waiting for my lol i love the nickname "Ltevo."

btw. im amazed no one said this yet. what I would REALLY love to see. is htc pull this stunt on the iphone 5. could you IMAGINE the fanboys shitting their pants! hahahaha

IMHO, this one is going to comeback to haunt Apple. Apple maybe able to pull these shenanigans over seas, but folks state side, don't forgive and forget that easily. Isheep are even swearing off Apple products, because this is bellow the belt.

I do silly things, like asking my grocery clerk "hey, are you planning on getting a LTEVO" of course get a reply "no, what is that?" I reply "Its a new device Apple got banned here in the USA, over a worthless patent" To my surprise, grocer replied "Thats why I would never buy an Apple product" Check that guy off Apples Xmas list.

I know some think its silly to bug your local representatives over such a trivial thing. I know its a phone :D I think what's really grinding gears here is once again Main Street folks are caught up in Wall St. Nonsense. Culture in this country is were up to there eye brows being stooges for profit.
The fact that this is trivial is what's going to upset your local representatives office. Your local representatives have more important things on the table. the fact that everybody has to answer to somebody and poop does roll down hill, makes Sense. :p. IMHO

Between advertising and app revenue, Google is expecting to make over $875 million (yes, nearly a billion) off of Android alone this year.

If Google had patented the notification bar, what would have changed? Only thing I see would have been all of us not being able to point out how great iOS 5 is, although we call it Android 1.6.

I guess I am saying that maybe not everything needs patent protection.

I got another email from BB this morning telling me the last launch date was made in error. The 23rd isn't the official release.
 
I would just like to point out that Radio Shack hasn't said word one to me about my pre order. I have half a mind to show up there today and act very upset to see if I can get anything knocked off. "What I take time off of work for this? You couldn't call your customer to keep them informed?? This is an outrage!!!".

I was actually reading some of the patents Apple had a year or two ago. I give Apple the credit for having the fore site, but a lot of the patents they got were ridiculous by how broad they were.

the way I read into this is the judge set the date in August for talks and everything until then will be business as usual, which for us should mean we are getting our babies very soon!...hopefully

as I said if I'm reading correctly into what ISN said, our phones should be available very soon (started moving from the warehouse this morning??) maybe before 5/23

it's bitter sweet but I guess I'm just happy I get to spend a bit more time with my beloved OG EVO :p
