4th Amendment not applicable in Michigan?

memory card slot? Couldn't they just take out your SIM card/memory card and read it from there?

not all phones have a sim card, and some dont even have memory cards. And depending on the phone you have some or maybe even none of your personal information will be on a data card. My Evo holds my browser history on the sd card but my Upstage(ancient) would not.

ACLU demanding Michigan State Police's release documents on how they use the devices

Anyone know of a way to protect our phones from these things? I don't have anything to hide but I don't like the idea that they might be scanning it without consent or a warrant. The idea that a traffic stop can be used as an excuse to rape my phone of all the personal data it contains is disturbing.

After Googling around I found that there is a Cellebrite UFED 2.0 soon to be released. I'm assuming it's designed to work with more models of phones.

I know, I know, I know. You simply purchase a tin foil phone cozy.

Works for those people that think they are out to be gotton. It protects them from reading out eletronical brain signal thingys, so it should work for our phones.

Yea cause as we all know no government employee has ever been accused of, no less caught abusing their power to look into people's personal info illegally. Back under your bridge troll.

Actually I was thinking about an app that would shut off the USB port for anything but recharging without a password. Not sure if it's possible but might be an idea for someone who knows more than do to look at.

I managed to dig up a few pictures of this today, pretty disturbing stuff :(

Personally, I think you're a little paranoid if you think the FBI, CIA, NSA, etc..... is secretly using these devices to spy on you. They've got to be physically plugged into your phone to work the best. I don't think anyone is physically plugging a device into my phone without my knowledge.

But what you are describing still falls under local shenanigans. Take that kind of power abuse and hand it to a federal agent who has broader powers and you'll agree that the potential for harm becomes more pronounced. He's just as much of a human being as the municipal cop that just showed all his friends a picture of someone's boobies :D

And you're right I don't know the same cops as you...

Just to clarify, I'm not a cop hater at all. I have always respected the hard job the police force has to do, and have always tried to keep a positive outlook in thinking that for the most part, law enforcement is on our side.

And these guys I'm using as examples, they are friends of mine. I wouldn't go so far as to say they're bad cops (well, the one that used to shake down drug dealers could be labeled that... way back in the day when I used to deal a little, he was my main supplier), just that they act like immature schmucks at times.

When I heard them talking about their stories off the record, it honestly surprised me. Made me realize that just because a guy has a uniform on, doesn't mean he's a law abiding robot. With power comes corruption. It's the way it is, the way it's always been.

It sounds to me as though the tech was made to be used on people coming into the United States from Canada, as some of the hijackers from 9/11 made their way into the US that way. So they make the need for it seem legit from an anti-terror POV.

I'm afraid you are mistaken. NONE of the 9/11 hijackers entered the US from Canada.

Hmmm... well I know they caught some terror suspects coming across the border at some point?

I believe the incident you are referring to is the person who tried to get across to the US by ferry in Victoria with explosives. That was in 1999.

Many of the 9/11 hijackers came from Saudi Arabia. Others came from other middle eastern countries. These were not caught.

just get yourself one of those 1970's-ish, hard wired cells... hook it all up like it's legit.... get pulled over, slide your real cell between the seat cushions... grab a hold of the "time capsule" and say here ya go...

Hey Sport, please learn what a troll is then get back to us. Bob is not a troll.

Yes, some abuse power. In most cases, illegally obtained evidence is tossed out of court. Some does get allowed and that is wrong; we are not perfect. Cops, DAs, judges, investigators, others break the rules and some innocents suffer. Again we ain't perfect and neither is our legal system.

I believe Stetson makes a better fitting tinfoil hat. I suggest you try that.

Not too sure what good shutting off the USB port would do. I thought we were talking about remote access.

depending on who they are or what their reasons are, it's not 100%

What do you have on your phone you don't want the law to see? :p

A wise man once said that those who will give up liberty for safety deserve neither. If you are worried about police invading your privacy, revisit your opinions regarding the "war on terrorism." Probable cause and search warrants aren't necessary any more.

LMAO, dude I was thinking the exact same thing. Carry an old flip phone with no nudies or anything on it, then pull the battery out of my DX if I ever get pulled over again (been 5 years), and throw it under my seat.

He might look at me a little queer when he see's me handing him a 2002 model Motorola flip phone, but oh well.

Actually, now that I think about it I think the incident occured after 9/11. Not sure if it was one guy or a group of guys from the middle east somewhere got into Canada, then used fake credentials to look like Canadian citizens to enter the US.

I know this happened at one time or another because in 2008 Canada completely redid their birth certificates and added multiple security measures built into the new certificate making them practically impervious to identity theft. This is what the new ones look like...

The incident involving the terrorists coming across the border was one of the main reasons they did this.

I just read that Obama might've actually been born in Canada and that's why the kerfuffle over his birth certificate.

You don't by chance happen to have any hot female cop friends who delight in pulling over middle aged men and having their way with them in that bunch do you...?

Can they still do this, if you have a password code on your phone?

Does anyone know the answer to this?

I think its pretty ludicrous to do this kind of stuff without probable cause. I mean if I get pulled over for a tail light out, or changing lanes without signaling, I'm gonna be pretty pissed if I'm forced to let an officer search my phone, and I'd likely tell him to go **** himself and end up on the nightly news.

Posted by an old friend, who recently friended me on fb. This totally blew me away. I simply cannot believe that this could be legal without a search warrant. If this doesn't amount to illegal search and seizure then I fear what's next for the people of Michigan and anyone who travels through it, and even worse for the rest of the country if this is allowed to stand and then gets adopted by other states.

The Michigan State Police responded to the ACLU with a statement here http://www.michigan.gov/msp/0,1607,7-123-1586-254783--,00.html that sounds suspicioulsy deflective and placating, and gives acheap response to why the MSP wants over half a million dollars from the ACLU to process the FOIA that was requested.

Trust me when I say I am not a huge fan of the ACLU but this is one of the better things they've pursued. Despite MSP's declaration that they do not use the devices during traffic stops, the ability is there to do so, and the threat of a search warrant- while the cop keeps you waiting, of course- is usually enough to coerce people into complying with their search.
"If you don't have anything to hide, then why not comply?" is a weak argument that basically tells you to give up your 4th amendment rights.

Agreed. I've been following this for a few days now. It's good that the issue is getting attention.

Lol, I wish! We have two women on the police force here in town and they're both lesbians (not together). And no I don't mean the kind that like to kiss on another female while sandwiching a guy... I mean the kind that can't stand guys. :(

One of them is kinda butch, the other one is really hot!
