Eris to v2.x, when?

If only we could get away from all the false "its here" posts. Its really sad the way some people take amusement out of others intrest. Forums are to spread knowledge and help people. Not to get cheap thrills at others expense. There I go ranting again. Need another drink. LOL ha ha!!

I wonder what NKT has to say about all of this? Maybe he can give us a better estimate of when we should be receiving the upgrade.

I bought my phone about a month ago and my vzw rep told me that the update was already being released when I bought it. Obviously he didn't know what the hell he was talking about and I was too new to this phone to be able to call him out on it....the guys in the store know nothing

Many of us if not all were told when we bought the ERIS that a new release would be coming out soon, and my rep pounded the idea that I would not need a Garmin after I saw Google Maps on the new release.

If they scrub the new release they will be subject to a law suit and believe me it will stick. When you can produce over 1,000 (probably 50K) people who were told the same story you will win. They will have to upgrade our phones to newer models at no cost or give us our money back and let us out of our contracts.

If by May 1st no release they will let me out of my contract with no penalty and I will not get an argument.

I'll demand an Incredible because it has 2.1.

Unless you got the assurance in writing that you would receive an update in a stated period of time, if at all, the agreement isn't worth the paper it's not written on. Period!

The first lesson to be learned here is that you should never take a sales reps word on anything. Every sales person I have ever known will lie, make up facts, distort facts and promise the moon to make a sale. They do so with a smile on their face and earnestness in their voice.

The same can also be said for service reps to a certain extent, because they get tired of dealing with angry customers all day. Until an "official" notification comes out stating dates and circumstances everything else being said is suspect.

Having said that, there have been official statements from Verizon and HTC that the Eris will be updated. The statement that it would happen in the first quarter of 2010 was inexact. As with most software releases, it is safe to just add at least three months to the stated dates.

The final lesson is that purchasing something that is supposed to get an upgrade is a buyer-beware proposition. Unless you get promises of upgrades in writing you have no reasonable expectation that failure to deliver is going to result in refunds or replacements.

As far as the Incredible replacing the Eris, I have my doubts. The Incredible is probably going to sell for around $200 with a 2-year contract. The additional features of the phone are more in the Moto Droid range than the Eris. If anything, Motorola needs to be concerned about the future of Droid sales at Verizon.

I am a new poster, but have been monitoring these forums for awhile.

That said, I call verizon 3 times, with 3 results.

call 1- transfered and disconnected
call 2- It is already sent to your phone, look up the system update......(obvious lie)
call 3- She looked at all of her outlets and saw nothing, put me on hold and talked
to tech support. They said it was origanally set to be released last month
but was put on hold. The guy in tech support figured there was some bugs in
it.

Agree.

Yeah, but then the Droid drops down in price and becomes the next Eris. Minus being a shit phone.

It plays second only to the Incredible, but will probably be $99 or less and still "Beats the iPhone" like it claims to do. While most of the potential Incredible buyers jumped early on to the Droid, some might still make the switch. These are the people that must have the latest and greatest, which is fine.

Also, original iPhone adopters have their two-year contracts expiring in June. If sales of the Incredible are slow the first two months, they will definitely pick up when people jump ship.

This phone really made the N1 (on VZW) irrelevant. Now we just need something that competes with the EVO 4G.

What's so great about the incredible...seems like an eris with a faster processor, better camera, bigger screen, and android 2.1 (which eris users can download)....in reality it seems very similar to eris just a little faster

So let me see, its faster, has a better camera, and a better screen. God I have no idea why anyone would want something like that!:D

Isn't that what usually happens with newer phones, they get better?

I've should of got a renewed for a 1 year contract instead of 2.

with new technology always arising they should draw up a better contract deal with phones.

seriously i am giving it till june if we get the update or not. If not i am gonna hack into it and put 2.1 myself

I agree with the spirit of that post, that question: "..what's so incredible?" .. as compared to the *usefulness* of the Eris.

There are plenty of folks who want the latest/greatest, but when something works fine for me it remains with me until I really do need to switch.

The Incredible does have better hardware, and it has 2.1 I gather; two huge improvements over the Eris and I dare say a step toward Nexus One. But I had a Nexus One and I can report that the real world differences between that device and my Eris were not enough to shake the world.

Why did I get rid of the N1? T-Mobile. 'nuff said. ;)

I still get a kick out of these forums.

Some random thoughts:
1) Most people that bought an Eris don't give a crap about about 2.1 or even know about it. That is unless they hang out at a few different forum sites.
2) The Eris on 1.5 is a great phone
3) It will get 2.1 OTA
4) When the Incredible is released there will be another better/faster/more powerful phone coming after it.
5) People that think they can sue VSW and/or HTC need to go drinking together and plan their strategy.
6) Sales reps are going to tell you anything to do their job, make a sale.
7) Kittens are just about extinct
8) OTD's avatar is hot!

I'd like to add to this what I've been saying all along:

a) The Eris was super cheap with a contract.
b) In another six or eight months the Incredible will also be "obsolete" if an LTE ("4G") phone arrives on Verizon. When that happens, we Eris users will be laughing at the Incredible users for paying an extra $200 for a bigger screen and faster processor.

I would like to add, the sales reps saying this over and over to thousands of people regardless whether in writing or not will be legally binding. Read your business law book with verbal contracts betwixt business and consumers. It is not a business to business contract.
Having said this I do not think we will not get the update as they have promised it to countless of people regardless if only verbal. Verbal is binding especially when you have 10,000 people with the same story.

This isn't an isolated case where 1 or 2 people claim a sales rep lied. Just making a point.

Sure, that's true techincally. But, practically there is no way there is any contract or case here. All these BusLaw experts talking about lawsuits and free phones are dreaming! There is no way, nada, no chance that this is going to happen. Even if you could identify someone who said something, everyone is going to say they were misheard or that the accuser was putting words in their mouths or that they were just restating the semi-official Verizon announcement. Add to that there are probably quite a few overstatements here and the fact that the preponderance of people claiming this are on this forum - making it seem more widespread than it is.

There may not be a legal position, bit Verizon has lost a lot of goodwill opportunity. In 10 years with VZ we have generally experienced.excellent support via phone, and usually with store techies. But the business guys have really blown this opportunity by.allowing misinformation to explode from the stores and on forums.

This is my rumor, speaking with a Verizon Rep at the store
The ERIS is taking longer because of the lacking options that it has, the droid has more options hence the quicker release for the droid. The Eris being all touch screen and lacking the options that the DROID has it will take longer as I was told. He said just wait and don't root. He said people have been bringing there ERIS phones in who have rooted and they have been having problems.
