And I must say I'm rather annoyed with this guy. He's monitoring the thread (I'm monitoring his profile), but he isn't making any more posts/answering any more questions. Raises questions...

I would bet he is verifying what he can and can't say before he responds.

Nothing we don't really already know, but you could look up the ID through the FCC's website and can uncover some juicy technical aspects I guess.
I can save you the trouble.

FCC ID NM8XXXXXXXX Is what he will post. Under the confidentiality agreement, you do not have to display a tag on anything you are not selling to the public. The FCC website will not display the information until after the date of the agreement expires.
So it would tell you nothing.

Secondly, the information is released in stages. So the full test would not be shown until the last of the agreement is gone.

The 99400 is either the hero2 or the nexus 2.

don't even start. Californians pay 9.25% on tax!

That is even more reason for us to find out if we get charged sales tax on online orders.

It would also be nice to know if Sprint is giving there mail in rebate via check or a VISA card.

These are two main considerations whether or not I will be buying the EVO from BB RS or Online.

I may be mistaken, but I think if an entity (Sprint, BB, or whomever you buy from) has a physical location in your state (regardless of where they ship from), they are required to collect sales tax from you so they can remit it to your state. This is how it works in my experience, but there may be other considerations involved here.

I would think you would always pay sales tax .. I have online anyways.. and every time I have gotten a rebate from sprint it is a check .. 6-8 weeks after I send it in.

Yes you get charged sales tax online.

This is correct. If you buy the phone through Wirefly, Let's Talk.com, or one of the other places on the internet, I.E. Ebay, Amazon, you most likely will not be paying sales tax.

If the place you are buying from has a location in your state then yes, you pay sales tax.

Otherwise, you do not.

Or there are state laws regulating eCommerce. Amazon is not based in NY, but NY passed laws that say eCommerce should be charged tax. I live in NY, an I pay NY sales tax when I order stuff from Amazon.

I knew I count on you guys for a good answer thanks.

I guess comparing apples to apples it is best to purchase from RS or BB.

RS is more likely in my area to actually have it in stock.

You're not gonna like this, but if you order directly from Sprint, either telesales, or its website, not only do you get charged tax REGARDLESS of which state you live in, but you will get charged tax on the FULL retail price of the phone REGARDLESS if you pay the discount price. So IF the retail price is $600, you will get charged tax on that amount even if you pay $199.

I live in Texas with 8.25% sales tax, but will be in New Hampshire with no sales tax if the EVO is released on June 6 as speculated. I'll have to see if I can buy it up there and skip the tax.

HTC does not charge sales tax (in NY) if you purchase thru them

HTC Online Store (US) - Free Cell Phones & Cell Phone Service
but sprint will not activate any phone that is not in their system. sprint will have all the ESN's validated in their system before sending out the phones to retail stores. they only activate the phones that have sprint logos on them. also i'm sure HTC site will not sell a sprint exclusive phone. if they do, they will do it on behalf of sprint, therefore sprint will charge the sales tax

JUST GOT THIS EMAIL FROM MY EVP REP NOTHING NEW BUT IT DOES SAY PHONE WILL BE RELEASED IN JUNE

They sell all the phones from all the carriers. They were selling the t-mo HD2 for $99 for a few weeks and The Verizon Incredible for $149.00 I just did a purchase (up to the final stage) and it showed tax(ny) $0.
