These are two main considerations whether or not I will be buying the EVO from BB RS or Online.
I may be mistaken, but I think if an entity (Sprint, BB, or whomever you buy from) has a physical location in your state (regardless of where they ship from), they are required to collect sales tax from you so they can remit it to your state. This is how it works in my experience, but there may be other considerations involved here.

I would think you would always pay sales tax .. I have online anyways.. and every time I have gotten a rebate from sprint it is a check .. 6-8 weeks after I send it in.

Yes you get charged sales tax online.
I knew I count on you guys for a good answer thanks.
I guess comparing apples to apples it is best to purchase from RS or BB.
RS is more likely in my area to actually have it in stock.

If the place you are buying from has a location in your state then yes, you pay sales tax.

Or there are state laws regulating eCommerce. Amazon is not based in NY, but NY passed laws that say eCommerce should be charged tax. I live in NY, an I pay NY sales tax when I order stuff from Amazon.

You're not gonna like this, but if you order directly from Sprint, either telesales, or its website, not only do you get charged tax REGARDLESS of which state you live in, but you will get charged tax on the FULL retail price of the phone REGARDLESS if you pay the discount price. So IF the retail price is $600, you will get charged tax on that amount even if you pay $199.

I live in Texas with 8.25% sales tax, but will be in New Hampshire with no sales tax if the EVO is released on June 6 as speculated. I'll have to see if I can buy it up there and skip the tax.

but sprint will not activate any phone that is not in their system. sprint will have all the ESN's validated in their system before sending out the phones to retail stores. they only activate the phones that have sprint logos on them. also i'm sure HTC site will not sell a sprint exclusive phone. if they do, they will do it on behalf of sprint, therefore sprint will charge the sales tax

No, check the site This store is relatively new, just a few months I believe prior to that you are right they only sold the Non-US phones

The N1 was PB99100 so N2 is a possibility. I thought MOTO was building that though, and MOTO phones tags usually start with IH. Doesn't seem like it'd be the Hero2 PB76100 though since I think that got FCC approved in February along with the GSM variant PB 76110 just recently approved.
