*Rezound ICS OTA is live Thread*

Folks, today is the last day of July. As you may recall, we were told by HTC that the Rezound should see its Ice Cream Sandwich update in either June or July, so we are quickly running out of time. What we aren’t sure about, is if it’ll happen today or this week or any time in the near future. The odd thing here, is that Verizon has apparently approved the update, something we first reported last week, but has yet to release it to the public. It could be that some last minute test came up or that they were waiting to get the DROID Charge update out first. Your guess is as good as mine.

You may also remember though, that HTC has posted the official changelog for the update twice now, only to pull it moments later. The first was on June 20 – the second posting was on July 18. If that’s not a sign that this thing should be ready, then I don’t know what is. In fact, the build that HTC references in their official changelog, is the exact as a leak that dropped in early June.

Any bets on whether or not we see the initial push begin today, so that HTC can meet their deadline?

No, the Eris was much worse off at that point. This is still...unacceptable, but not as bad as the Eris. It was close to unusable on Cupcake, and it really needed FroYo for storage purposes and HTC chose not to update it.

Eclair... My bad. I thought 2.1 took forever, and the VZW reps who got the Moto Droid thought they were so cool, they claimed our Eris phones couldn't handle 2.1. Anyway, I got my Eris in April 2010 and the update came out in what, July? I figured this would take just as long but apparently not.
 
May as well throw Droid life into the mix. Not that the article says anything definitive.

One of the commenters on that DL article was considering filing a complaint with the FCC, which isn't a bad idea. Considering the early 2012 update was mentioned at the launch event and in their press release, it certainly sounds like a candidate for going after them for false advertising. Any reasonable person wouldn't mistake July for "early" 2012, especially considering it's the 7th month out of 12, which is over half. On the Verizon forums the mods keep reminding that no phone is guaranteed an update, while the posters keep bringing up the press release saying early 2012. We've only got a few more months before it becomes a year after launch, and it's late 2012.

With Verizon taking away their customers upgrade & plan options, & then opting out of any bonuses available from manufacturers (Google Wallet, 50GB of Dropbox & Samsung Music Hub for the S3), I'm starting to wonder if the good coverage (and the higher than everyone else cost) is worth it to stay with them.
 
Personally, I still don't believe that there is any legal action we could take. However, complaining about the issue is still a great option. Hit up Twitter, Facebook, Google+, and all the little forums out there and just complain. Tag Verizon and HTC wherever possible. Heck, tag your local news channel's pages. Bombard the crap out of every social media site and drag every journalist you can find into it. If it is really that important an issue, something will happen. If not, then perhaps it isn't worth the hassle anymore, and I mean Verizon. Maybe they aren't worth the trouble to deal with them anymore. Sure, the other carriers aren't any better, but we're not having trouble with the other carriers at the moment. If Verizon and HTC lost some customers, it might make them think a little harder about trying to keep them happy.

Verizon actually answers their status updates from angry customers pretty well on Facebook.

I'm going to try and call them tonight. This is a little ridiculous how what should be considered a top-tier phone is now being treated like the red-headed step-child...though I guess we should have known considering the guts of the phone are red.

I think legal action is viable. They put it in print. When people were considering which phone to buy last year, especially between the Rezound & the Nexus, the fact that it was supposed to be upgraded in the near future was definitely a selling point to me, and possibly what was the deciding factor. I looked at the specs for both phones and, to me, the specs on the Rezound were better than the Nexus (HTC build, screen Res & ppi, size). But the one thing that worried me leading up to the announcement was if it was going to be a long road to an update. The Nexus was a lock for quick updates (or so we thought, we didn't factor in Verizon to the mix) so that's what I was going back and forth on deciding what phone to upgrade to. If they had said that they'd have to investigate that further, or you'll get it but it's going to be a long wait, I may have very well gone with the Nexus (or even the Razr considering how well Moto was with updates last year).

Like others have said here, one of my biggest gripes with Verizon is their lack of communication with their customers. Take any phone launch, anytime they change their plans, etc. They never let any info out until days before it happens. It's almost like they know you'd be PO'd with the end result and they want to string you along for as long as possible. My other biggest gripe with them is their support & sales staff. Call them 5 times and you're probably looking at 5 completely different answers. How hard is it to have weekly meetings and get your employees on the same page? At this point I'd settle for getting at least their supervisors on the same page. Apparently the $30 upgrade fee isn't enough to make that happen.
 
Only on the new family share plans. Looks like they can still charge if running an unlimited data plan (at least that's what I read in the post about this in the news section of the Phandroid app/website).

It's any phone that uses 4G LTE. That's the whole deal, they bought that bandwidth with the express agreement that people can use whatever device they want however they want on it. Here's the FCC summary:

They are saying up to August and then 45 days after that potentially. How in the heck is the max of middle of October early 2012?

There is no doubt in my mind that Verizon uses these updates to manipulate sales, which is in my opinion unethical. It's bad business to screw people over like this, and it should be looked into by the Federal Trade Commission (not the Federal Communications Commission, which deals with the technological aspect of it). However, I am pretty sure that Verizon has all of their ducks in a row when it comes to the way they word things. Big business rarely make real promises... they just make us believe that so we feel we can trust them. Terms like soon, early, quickly, timely, and patiently have very different meanings from a legal point of view. Some examples:

Ice Cream Sandwich coming soon!
We read: Oh, I can buy the phone now because it's going to be updated soon!
They mean: We'll send it out as soon as we feel that we've made as much money as we can by withholding it.

Android 4.0 to be released in Early 2012
We read: Sometime before summer, I'll have the newest software available!
They mean: Before Christmas

We're working on releasing the ICS update as quickly as we can.
We read: They must be running into some bugs, but they're staying up all night to fix it and get it out!
They mean: It's Friday, let's leave early and go drink Maker's Mark and laugh at all the people at the bar with Rezounds... QUICK BEFORE THE BOSS COMES!

We are working hard on releasing the latest update in a timely manner.
We read: What's this 4.1 coming out now? Well, they said 4.0 would be out in a timely manner, so we'll get it before 4.1 hits the Nexus.
They mean:We'll put it out before Google comes out with 5.0, or before the court orders us to.

And my personal favorite:
Thank you for waiting patiently while we work hard on releasing Android 4.0.3 to your HTC Rezound. We're working quickly to push this over-the-air update as early as possible, and you should see it on your phone soon.
We read: Our patience is growing thin, but we know you're trying your best. Please hurry.
They mean: Please don't burn down our buildings and chop down our towers...

The FCC has bigger fish to fry, like censoring those who exercise their right to free speech and preventing people who steal cable from downloading naked pictures of government officials. FTC FTW

By the way, here's the text of my FCC complaint which I just finished filing:

In November or December of 2011, I purchased a mobile device, Model Number ADR6425LVW, aka "Rezound," for a subsidized price of ~ $290 after discount (which was less than I originally was led to believe) and including tax, upon the renewal of my contract. At that time, every indication was that its Operating System (OS) was going to be upgraded to a more recent firmware by an Over-The-Air (OTA) update within Q1 or Q2 of 2012. As of today, July 31, 2012, this OS has not yet been "pushed" by Verizon Wireless (VZW) to the phone.

Between the date of purchase and today, the company has made SEVERAL claims that this OS would be distributed. The first claim was in the initial sales brochure at the date of purchase. VZW also continued to publish through several online media "posts" that this update was still in the works. By the end of Q2, both the manufacturer of the device (HTC) and VZW made claims that the software was going to be ready "during June/July 2012" and that it would continue throughout the month of August once it had begun.

Again, to date, there has been no sign of said OS update from users/owners of the Rezound, nor from HTC, nor from VZW, through any online social media outlets, with which they continue to post updates about new products, indicating that they are still active with these advertising methods.

The upgrade to the more current "Android 4.0" OS is said to be a vast improvement in both performance and user satisfaction in current devices. Claims of improved battery life (which the Rezound is inherently in need of due to its high-powered processor) and improved signal strength and response have been reported.

The Rezound uses VZW's "4G LTE" technology, which was a huge marketing factor for the device but is inherently intermittent due to its current OS "Android 2.3.5", which is itself one year old and based on "Android 2.3", released in December 2010. This nearly antiquated software has theoretically restricted the phone's capabilities to an almost undesirable state for some, while VZW continued to market similar mobile devices touting lower-end hardware but more recent versions of the software.

Furthermore, there have been rumors that the current software has been configured for the device by the manufacturer and was sent to VZW for approval. Indeed, versions of this updated firmware have been unofficially "leaked" throughout various internet websites, and has been shown to work exceedingly well in the device. But installation of this software through these unconventional methods requires a technical skill exceeding that of the average intended customer, and is therefore limited to "developers, hackers, and techies." These types of users, in turn, do their best to help others install the software. Unfortunately, this sometimes results in consumers "hacking" or "rooting" their device to obtain the best possible performance, knowing the risk subject their device's ability to operate, which is not covered under warranty.

It has been speculated by myself, and others whom I have encountered through social media websites and forums, that VZW has intentionally delayed the release of this current OS in order to maximize sales of other similar devices, force impatient customers to return their Rezound devices for lesser units (which in turn forces them to change their contract), or void the warranty of their phone. This can be seen as a manipulative and deceiving business practice, which I personally consider unethical.

Anything else anyone want to point out? I only had 3500 characters to work with... a huge limit to me when I'm typing and cranky.

"I'm a current HTC Rezound owner. When you first released the Rezound with Verizon, you stated that Ice Cream Sandwich update for Android would be available in "early 2012." Just recently, you stated that it would be available by June/July. It's past early 2012 and it is July 31. Where is the ICS update? I would like a straight answer."
I know that came out a little harsh but I'm sick of their games.

Their response:

HTC "Hey, Ben. We were shooting for a June-July update window but that was just our target date range and it was always possible that it could change and we spelled that out at the time. Updates are complicated and there are many twists and turns in that process. We apologize for any confusion and we're working as hard as we can on bringing it to you as quick as we can. Thanks for all of your patience."

I have to say I feel a little bad for HTC, they've proven numerous times before that they will go the extra mile for their customers. All of the signs of accountability seem to point towards Verizon.

Although not getting ICS is going to frustrate a lot of us, a simple "hey we're sorry and the reasons for the delays are xxxx but we are working on a release for date xxxx" would go a long way instead of just going the silent route.

Paying this month's bill to Big Red is going to have an extra sting to it.

Yup... sounds like a typical HTC response. It's kinda moot at this point, as nobody has said anything. I'd be a little more understanding if anybody said something, but I think HTC is just forwarding out that generic reply... even though I believe that they did their job. I want to say it's all Verizon's doing.
 
Sorry to disappoint, but I just checked for software updates on my two Rezounds, came back with the usual "No new software update available" on both devices.
