I believe the following link is a separate filing of preliminary injunction against the GS3 and not an add-on to the Galaxy Nexus ban request...1) Apple is a multi-billion dollar company, 96Mil isnt all that much to them
2) The 96Mil is held by the court until the end of the trial so Apple wont lose any money unless they lose to Samsung (the money is used to cover Samsung's losses should Samsung prevail)
Also, sales of the Nexus can continue until Apple puts up the 96Mil, which really, probably has already happened/will happen shortly since its not that much money to them.
Im not super worried about this case since Apple declined to amend their complaint to include the S III, therefore giving S III vendors at least a couple of months to sell the phone (since even after the lawsuit is filed, Apple needs to request an injunction against importation of the S III and court dates have long waits) so at the very least we should get our phones.
If Apple prevails in their case against the Nexus however, it will make it easier for them in their suit involving the S III, assuming they sue under the same patent and Samsung is using similar code.
Apple denied stateside Galaxy S III injunction -- Engadget
Frankly, the sale of the Galaxy Nexus is a small fraction of the Galaxy S II. And the Galaxy Tab 10.1 sale number is very disappointing as well (although I love my G-Tab 10.1). So I wonder it might merely be a "consolation prize" Judge Koh is giving Apple, since she has denied Apple request to have preliminary injunction on the GS3?
There is one more week to go. I hope no more bad news from Judge Koh's court to derail the GS3 release.
