Enable it as Device Administrator in Settings/Security/Device Administrators. Also go to Settings/Lock Screen and change it from Swipe to None.

A clean flash is worth a shot for fixing your problem

You said you clean installed and then upgraded. I'm saying to clean install v3.1. Use the JB Wipe All x2 zip and flash v3.1.
